As you are aware, every year Railway Board communicates instructions to the General Managers of the Indian Railways to permit Muslim Railway Employees, observing fast during Holy month of Ramzan, for early leaving office, but this year, orders to this effect have not yet been issued by the Railway Board.

It would, therefore, be quite appropriate if necessary instructions are communicated to the General Managers of the Indian Railways to permit Muslim Railway Employees, observing fast during Holy month of Ramzan, for early leaving office.

An early action in the matter shall be highly appreciated.

Compassionate Ground Appointees i.n erstwhile -1 S pay scale who have completed 5 years but who have not acquired the minimum SSC/ITI qualification are given an extended period of 2 more years for acquiring the minimum educational qualification for the post. Copy of Board’s instructions in this regard to Zonal Railways/Production Units is enclosed.

2. In continuation of earlier correspondence referred to above, it is again requested that such trainees may be impressed upon to acquire the requisite qualification either through open school or other opportunities in this respect including National Council for Vocational Training (NCVT) examination conducted by Regional Directorate of Apprenticeship Training (RDATs).

A lot of water has flowed under the bridge since the historic 1974 railway strike which was proposed to start on May 8th but it actually started on May 2nd, 1974 after the arrest of Com. George Fernandes the then President of AIRF at Lucknow after he addressed huge labour day rally on 1st May. After the news of arrest of Com. George spread, strike engulfed various parts of Indian Railways but complete shut down happened on 8th May and it was called off on 28th May, 1974. Railway Strike brought the nation to a halt but even today this strike is remembered as most significant happening after the independence of India. The strike was a result of rocketing inflation and anguish of railway workers against the plights which they were facing due to anti labour policies of the then regime, it turned out to be a major uprising against the system. Workers were hopeful that third pay commission would give some relief but the condition of workers did not improve and as a result under the leadership of Com. George Fernandes, who was then president of All India Railwaymen’s Federation (AIRF), railwaymen went on strike on 8th May, 1974 which lasted for 20 days.

Such was the effect of the strike that many other sectors such as banks and insurance employees joined the strike with AIRF for a day and brought the whole country to standstill. Government unleashed severe atrocities on the cadre of AIRF, several railway workers were removed from service and many others sent to jail for as long as 18 months. During this strike 50,000 Railway workers were arrested, over 10,300 Railwaymen were dismissed from service, service of over 5,600 temporary employees were terminated and 4 employees lost their lives. This was a historic strike which attracted worldwide attention. This strike was also a contributory factor in the landslide defeat of the Congress Party, which was responsible for forcing the workers to go on strike. No doubt 1974 strike lasted for few weeks but it produced that much socio-politico-economic effect that whole country was put under emergency in 1975 and Indira Gandhi Government lost general elections in 1977 and first non-congress Government was formed at the center.

The main demand of the employees was payment of bonus under bonus Act. While the Factory Act was in practise railway workers were not treated as industrial employees but as government employees.” The strike had had a great impact as the employees were reinstated when the new government came to power under Madhu Dandavate who was the Railway minister and the productive linked bonus which came into existence in 1977-78 which is still in vogue was due to the strike.

AIRF went on to follow the legacy of warriors of 1974 and continues to do so even when threat of privatization looms large on Railways. AIRF is fighting with great intensity and ferocity for the socio-economic upliftment of Railway staff. AIRF has done a lot to organize women workers in Railways, active participation of women workers is ensured in Trade Unions through various means and it is heartening to mention that response is overwhelming.

Comrades, Let us all come together to pay a true tribute to the martyrs of AIRF and make AIRF more powerful so that protecting the present, future and family of each railway worker is ensured.

Organized laborers and strong unions are always needed.

Sub: Long pending burning issues of the Railwaymen

In reference to our earlier letter of even number dated January 22, 2019, all the three issues, which have been discussed with your goodself, in the presence of the MS and CRB, i.e. revision of rates of Running Allowances and other allowances related to Running Staff, as has been informed to us, has been sent to the MoF(Deptt. of Exp.), but not traceable there, implementation of four-grade structure(in the ratio of 10:20:20:50) in case of Track Maintainers, the file, as has been informed to us, has been sent to your goodself by the M.E., the case regarding restructuring of the IT Cadre, it was informed to us, has also been forwarded to your goodself by the F.C.

Since all the above-mentioned issues have been agreed by your goodself, being delayed at various stages, need to be resolved at an earliest to avoid mental agony of the concerned vulnerable categories of the Railway employees.

We are quite thankful for your directions to the Railway Board for filling-up of vacancies. This will definitely improve the efficiency and productivity of the Railways as well as will provide some relief to the Railwaymen who are working beyond their duty hours under lot of stress.

Dear Sir, the Indian Railways, at present, have almost more than six lakh Railwaymen, who are covered under National Pension System(NPS) and are having lot of anguish against this scheme. Many a times this issue has been raised by the AIRF as also by the NC/JCM(Staff Side) and NJCA. The staff working under this scheme is agitating here and there, but their main demand of Old Pension Scheme is not being considered, resulting in lot of frustration amongst these staff. Since at present you are also looking after the Finance Portfolio, it is our humble submission that, the letters written by the Hon’ble Railway Ministers for bringing the Railwaymen under Old Defined Pension Scheme, should be restored for the Railwaymen who are working under all arduous and hazardous circumstances 24X7, all weathers, as also more than 400 to 500 Railwaymen are sacrificing their lives, for running the lifeline of the country, every year.

We sincerely hope that, you will kindly look into the above burning issues and will try to resolve these at an earliest.

Sub: Brief of the meeting held today with Hon’ble Minister for Railways on the burning issues of the Railwaymen

Today I had detailed discussions on the pending major issues in a meeting with Hon’ble Minister for Railways in the presence of CRB and Member Staff. The meeting was held in a very cordial atmosphere and I noticed quite positive attitude of Hon’ble MR on almost all the major issues. Brief details of the discussions held is as under:-

(i) Revision of rates of Running Allowances and other allowances related to Running Staff – This issue was discussed threadbare and Hon’ble MR had reservations about the proposed rates on the plea that, it will result in further increase in operating ratio. He also said that, according to Finance it comes to Rs.398/-. I explained the matter in detail and also advised him about the formula, on the basis of which it comes out to Rs.648/-. Finally, he agreed to further process the case file to MoF for Rs.525/- and advised the CRB and MS accordingly. It is expected that the case will be sent to MoF shortly.

(ii) Four-grade structure(in the ratio of 10:20:20:50) to Track Maintainers – This issue was also discussed in details and it was explained to Hon’ble MR that; the entire process is financially neutral. He directed the MS to issue orders immediately, because it has been already agreed with the AIRF in previous negotiations.

(iii) Restructuring of IT Cadre – I explained that, all the Cadre Restructuring have always been based on the sanctioned strength of the cadre and not on roll as also entire process of Cadre Restructuring is always with financial neutrality, as such, same principle should be applied in case of Cadre Restructuring of IT Cadre also. I also reminded him that, this issue has been agreed by the FC in his chamber during discussions. Hon’ble MR agreed to it and advised the MS to take action accordingly.

(iv) Promotional prospects of educated staff working in lower grades in GP Rs.1800(Level-1 of VII CPC) – I mentioned that, a large-number of highly educated people are available now in the lowest grade, who are very much curious for their career advancement. I further mentioned that, AIRF has already proposed the Railway Board to divert 10% posts, earmarked for Direct Recruitment, to LDCE open to all, so that, qualified Track Maintainers and staff of all departments and categories, who are having academic qualification, prescribed for Direct Recruitment on these higher grade posts, can be considered for promotion, which will definitely give some relief to such staff. Hon’ble MR was in an agreement with this proposal and asked the CRB and MS to take necessary action in the matter.

(v) Advancement prospects for the staff in erstwhile GP Rs.1800 and GP Rs.4600 – I explained to Hon’ble MR that, in view of poor prospects of advancement, there is serious discontentment amongst the staff working in the said two grade pay. AIRF has, therefore, proposed that, 50% posts in GP Rs.1800, i.e. Level-1 of VII CPC, be upgraded to GP Rs.1900, i.e. Level-2 of VII CPC, with financial neutrality. Hon’ble MR also agreed to this proposal and advised the CRB and MS to take necessary action in the matter.

So far as promotional prospects of the staff in GP Rs.4600 is concerned, it was informed that, Board is working out some solution to convert some posts of GP Rs.4600 to Gazetted Cadre.

(vi) LARSGESS – On the issue of LARSGESS, Hon’ble MR said, that, the Attorney General has very clearly written that, this scheme is unconstitutional, hence will not sustain before the Hon’ble Supreme Court. In the wake of this, we are proceeding to Hon’ble Supreme Court with those cases who have completed all formalities. On the issue of LARSGESS, AIRF is also likely to file a petition in the Hon’ble Supreme Court, and for that we are in consultation with the eminent lawyer.

Apart from the above, I also discussed the issues of Guaranteed Pension to NPS covered employees and improvement in Minimum Wage and Fitment Formula and requested Hon’ble MR to convene a meeting with Hon’ble Prime Minister on these significant issues. He assured that he would take these issues with all seriousness and would try to arrange a meeting with Hon’ble Prime Minister.
