OF JCM LEVEL COUNCIL OF DGQA

(i) This HO letter No A/90643/XII(24th)SC Meeting/DGQA/ADM/JCM Dated 06 Mar 2019

(ii) Leader Staff Side Letter No. MKR/JCM III/DGQA/2018 dated Mar 2019 and letter of even number dated 08 Mar 2019.

(iii) AIDE-F Letter No. 04/1004/MLN/ALDEF/19 dated 06 Mar 2019 addressed to Secy (DP)

iv) Secy Staff Side, letter NO INDWF/DGQA/Placement/07 dated 27 Feb 2019.

2. Leader Staff side vide his letter under reference has requested for change of venue of the Steering Committee Meeting from Badmal, Bolangir, Orissa to New Delhi

3.In the meantime. several representations. as referred above. have also been received Keeping in view, the importance of the issues raised in the representations, the subject Steering Committee Meeting has now been converted into Main JCM Meeting to be Chaired by the DGQA.

4 Accordingly, a Meeting as mentioned above is scheduled to be held at HQ DGQA. on 28th of Mar 2019 in Room No. 84. G Block. Conference Hall. of the Dte of Vehicle, DGQA, from 1100 Hrs onwards.

5.It is further pointed Out that the Agenda of the meeting will include all points referred by the Federations in their letters to the Secy (DP) or any other point that the Staff Side may like to raise during the course Of the meeting.

6. All Staff Side members are accordingly requested to make it convenient to attend the meeting.

7 The Staff Side members may report one day prior to the date Of meeting

Dear Comrades,

The 47th meeting of the National Council was held on 13.4.2019 at Rail Bhawan, New Delhi, under the Chairmanship of Shri P.K.Sinha, Cabinet Secretary. It was held after the most inordinate delay i.e. after the lapse of nine years that the National Council meeting was convened. The decision of NJCA to organize Dharna on 28.3.2019 (which was deferred) is what triggered the Government to convene the meeting.

The meeting commenced at 11.30AM and ended at 2.30 PM. In the introductory remark, the leader and the Secretary Staff Side touched upon the following points.

1 Survival of JCM ;revival of Departmental Councils; maintenance of its stipulated frequency.
2 Closure of offices- restructuring consultation with the Staff Side and Unions affected; with particular reference to CPWD, Printing Presses and Defence Industry.
3 Increasing litigations; Governments disregard to its own National litigation policy making employees and pensioners to incur huge expenditure. Non implementation of even Supreme Court decisions- MACP promotional hierarchy, MACP date of effect, increment on 30th June and 31st December etc
4 NPS and other pension related issue
5 Recognition Rules, delay in the grant of recognition
6 Arbitration Awards.
7 Non honoring of the assurance held out by the GOM to revisit the minimum wage and fitment formula
8 One more option to switch over to the 7th CPC
9 Non issue of clarification on the question of minimum pay for promotes after 1/1/2006
10 Reduction in the quantum of Night Duty Allowances
11 Ex-Service man pay fixation
12 Compassionate Appointment and its restriction
13 Outsourcing and Casualization of permanent Jobs
14 Regularization of Casual workers- include casual service for pensioner benefits
15 Running Allowance of Railway Workers with tax free banefit
16 CGHS deficiencies
17 Necessity to hold meetings by held and pension Secretary with Staff Side
18 One time relaxation for LTC-80 fare

Railway Board’s order dated 30.01.2017 curbing workers’ rights – Walkout by Federations from DC/JCM meeting today i.e., 07.03.2017

Subject: Railway Board’s order dated 30.1.2017 curbing workers’ rights.

In the DC/JCM meeting held on 7.3.2017, during Opening Address, both the Federations have taken a stand that the unconstitutional order dated 30.1.2017 preventing Safety (Supervisory) Staff
from becoming Office bearers should be withdrawn by the Railway Board immediately to facilitate negotiations to resume.

The President, General Secretary, Working President etc. have conveyed their strong protest against the Board’s letter dated 30.1.2017.

The General Secretary/NFlR had stated that the Railway Board has betrayed the Federations and the Railway Board has equally failed on several counts on written commitments. notably:

a) Replacement of GP 4600 with 4800

b) Upgradation from Gr.C to Gr.B (Gaz.)

c) Allotment of GP 4600 to Loco (Mail)

d) Stepping up of pay of Loco Inspectors inducted prior to 1.1.2006

e) Arbitrary reversal of various decisions given in the past (as a result of agreements with the Federations) and without caring to consult federations.

f) Track Maintainers upgradation (written commitment of Board)

In light of Railway Board’s total failure, the Federation (NFIR) conveyed that it is not in a mood to participate in the negotiations of DC/JCM forum and at the same time demanded immediate
withdrawal of Board’s order dated 30.1.2017, if the Railway Board sincerely feels that industrial relations are required to be preserved.

With the above observations in the DC/JCM meeting, the leaders left the meeting place. Both the Federations have jointly walked away from the meeting.

Please convey to all employees the above development, as the Railway Board’s order is a direct attack on the rights of workers, whether they are Supervisors or Non-Supervisors and it is a gross violation of Trade Union Act, ID Act etc.

Also convey the “Walk Out” decision of Federations to GMs, CPOs etc.
