Long pending demand on retirement age of CAPF (CRPF, BSF, ITBP, SSB, AR and CISF) is fulfilled – Uniform age of retirement of all CAPFs irrespective of the Ranks

Ministry of Home Affairs said in the order published on 19th August, 2019 a decision regarding the retirement age which will be uniform for all members of CAPFs, irrespective of the ranks including CISF and Assam Rifles at par.

ORDER

Dated, the 19th Aug, 2019

WHEREAS, Hon’ble High Court of Delhi in WP(C) No.1951/2012 in the matter of Dev Sharma, Dy. Comdt. of ITBP Vs UOI & Anr. on 31.01.2019 directed the respondent to arrive at a decision regarding the retirement age which will be uniform for all members of CAPFs, irrespective of the ranks including CISF and Assam Rifles at par and also to decide the date from which such change will be effected.

However, the Court did not allow stay of the retirement of any personnel as per the existing age of retirement who might have retired before passing the order except that in the event of enhancement of retirement age, the differential period will be added to the period of service actually rendered for the purpose of pension.

2. In view of the aforesaid order, the matter has been examined and in compliance thereof, read with order dated 04.02.2019 passed in WP(C) No.695/2019 titled Ram Chander Kasania & Anr of BSF Vs UOI & Ors, it has been decided by the Competent Authority as under :-

Force Irrespective of rank
CRPF, BSF, ITBP, SSB, CISF, AR**(regular cadre of Paramilitary Component) 60 years.

a) Age of retirement will be as under:

b) Date of effect will be the date of issue of order.

c) In respect of all the 29 petitioners as stated in para-02 and 03 in common Court order dated 31.01.2019 barring Petitioner No.09 in WP (C) No.4859/2013, relief as granted at para-72 of the order be extended.

d) As regard those whose date of superannuation fell in between date of judgment and date of issue of order:

i. Those who have got interim stay will be deemed to have not superannuated and will be governed by age of retirement as at (a) above.

ii. Those who have retired but did not approach any Court will be governed by the Court order dated 04.02.2019 clarifying para-72 of original order dated 31.01.2019 in Dev Sharma case (supra) and hence will be entitled to exercise options either for joining after returning all pensionary benefits, if received or will have an option to have benefit of fitment of pension on completion of age of 60 years.

3. All Forces are directed to comply with the Court orders narrated as above. Forces may amend provisions of Rules as applicable on above line.

Retirement age for all Central Paramilitary Forces Personnel fixed at 60 years

The Central Government issued orders on Monday regarding the retirement age of all Paramilitary Forces Personnel including CRPF, BSF, ITBP and SSB will now retire at a uniform age of sixty years irrespective of their ranks.

Revision of age of retirement will come into force from 19.8.2019.

At present, all personnel in the CISF and the Assam Rifles retire at the age of 60 while personnel from the ranks of constable to commandant in CRPF, BSF, ITBP and SSB retire at the age of 57.

Those above commandant rank in CRPF, BSF, ITBP and SSB were retiring at the age of 60.

“According to the order issued by the ministry of home affairs, the personnel of Central Reserve Police Force (CRPF), Border Security Force (BSF), Indo-Tibetan Border Police force (ITBP), Sashastra Seema Bal (SSB), Central Industrial Security Force (CISF) and Assam Rifles will superannuate at the age of 60, instead of 57 years for certain rank of officials.”

The order directed all the forces to “comply with the court order and amend provisions of rules.”Similar Posts:

Premature Retirement of Railway Employees: Criteria for Review of Services

Railway Board issued an important order on 8th August, 2019 regarding periodic review of Railway employees under Rule 66(b) of RSPR 1993.

The order said, improving of efficiency and strengthening of administrative machinery at all levels by the Government by exercising of its powers under Rule 1802(a)/1803(a)/1804(a)-R.II, 1987 read with Rule 66(b) of RSPR, 1993 to retire a Railway servant in public interest before the normal date of his retirement subject to fulfillment of conditions laid down in the instructions.

The salient points of the various instructions on the subject have been consolidated with a view to improving clarity and understanding and are enclosed for reference.

An important aspect of Criteria for review of Services as per age and service rendered…

1) Group A and B: After attaining 50 years (if entered service before age 35)

2) Group A and B: After attaining 55 years (if entered service after age 35)

3) Group C: After attaining 55 years of age

4) Group C: After completion of 30 years of service, if not governed by any pension rules, under Rule 1804(a).

5) Group D: In pensionable cases, can be done after completion of 30 years of pensionable service.

6) Any employee, irrespective of age, can be retired prematurely by giving him three month’s notice after he has completed 30 years of qualifying service.

In Lok Sabha on 24th July, 2019 Minister of DoPT Dr.Jitendra Singh has given a written reply to a question about the policy of removal of non-performing civil servants.

“The provisions of Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rules, 1972 and Rule 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958 lay down the policy of periodic review and premature retirement of Government servants, which is a continuous process.

As per these, the Government has the absolute right to retire Government officials prematurely on the ground of lack of integrity or ineffectiveness, in public interest.

For the period July 2014-May 2019, a total of 36,756 Group-A and 82,654 Group-B officers have been reviewed under FR 56(j)/similar provisions, out of which FR 56(j)/ similar provisions have been invoked /recommended against 125 Group-A and 187 Group B officers”.Similar Posts:

The retirement age to 65 years for the officers of Teaching sub-cadre of Central Health Services (CHS).

RETIREMENT AGE IN CHS

Government had decided on 05.06.2008 to increase the retirement age to 65
years for the officers of Teaching sub-cadre of Central Health Services (CHS). Thereafter, Government decided on 31.05.2016 to increase the retirement age to 65 years in respect of General Duty Medical Officers, Non-Teaching and Public Health Specialists.

Further, it was also decided on 27.09.2017 to increase the retirement age to 65 years for the other officers of Central Medical Services viz. AYUSH doctors, Civilian doctors under Directorate General of Armed Forces Medical Services, Medical officers of Indian Ordnance Factories Health Services, dental doctors working under Ministry of Health and Family Welfare, doctors of Indian Railways Medical Service and dental doctors under Ministry of Railways, doctors of General Duty Medical Officers sub-cadre of Central Armed Police Forces and Assam Rifles and Specialist Medical officers of Central Armed Police Forces and Assam Rifles.

Health being a state subject, the decisions of the Central Government are not applicable to the State Government doctors, and no such information is being maintained centrally in respect of State Government doctors.

No irregularities have been noticed in the implementation of the said decision.
