QUOTE: The Finance Ministry invited us for a discussion based on the memorandum we had submitted to Department of Financial Services and RBI. The meeting took place at the Office of Mr. Ravi Mittal, Additional Secretary Finance. Mr. Amit Agarwal, Joint Secretary, DFS also joined.

Discussions were held on the following issues:

1.Wage Revision: The talks have resumed but the issue of Mandate and Quantum has to be settled. Lady Officer’s issues were to be taken care.

The response was positive. The addl. Secretary said “Your arguments are well taken. We will see what best can be done”

2.Appointment of Officer Director / Employee Director: The response was that steps have been taken.

3.Implementation of the recommendation of Parliament Standing Committee on NPA: The response was that the Standing Committee is going to come up with fresh recommendations soon.

4.Levy for Tax on Net Profit: The response was that it will be explored with the concerned ministries.

5.Tax on CRR: The response was that it is an issue RBI has to decide.

6.Reimbursement of Expenditure on Govt Schemes: No response

7.Cross Selling: The response was very positive. The officials are also of the opinion that the income should be credited to the Banks commission account.

8.Review of RBI Policies; PCA, NCLT etc: Now no proposal for Bad Bank. The issues are to be taken up with RBI.

9.Service Tax on Banks for on Services Charges waived: The response was that efforts are on to solve the issue.

10.Superannuation Benefits: We have submitted detailed memorandum related to various issues concerning superannuation benefits.

11.General: The Banking Sector may take another two years to get rid of the problems. Image of the Banking system has to be restored by all of us together.

Comrades, this is the first time we were invited for an official discussion. The discussions were positive. The dialogue should continue.

Dear Sir,

Issues affecting Banking Sector

Thank you very much for inviting us for a discussion. We thank the Ministry for the following:

1.The IBA has called us for the Wage Negotiation on 5th May 2018 after our meeting with the Secretary, DFS on 21.03.2018.
2.The implementation of Ind As has been deferred by one year giving small relief to Banks.
3.RBI has reduced the provision for accounts transferred to NCLT by 40% instead of 50%.
4.The provision for Investment Fluctuation has been allowed to be spread for 4 quarters instead of one.

However the following issues remain and we request your urgent intervention.

Wage Revision: The issue of restricted mandate has not been settled yet. SBI, PNB, UBI, Indian Bank, CBI and BOB have given restricted mandate. This requires your personal intervention.
There is widespread disenchantment with the salary structure. Recently Karnataka, Andhra Pradesh and Telengana Govts. have given a good salary hike. Hence, we request your intervention for a decent wage hike without looking at the Net Profit as Banks are instrumental in implementing the Govt. schemes without any compensation. Moreover, in the last 3 years Banks have written off Rs. 2,41,000 Crores and our Wage Revision cost will be negligible in comparison. Without employee satisfaction the Banks can’t grow.

The starting basic of an officer in Govt is Rs.56100/-
The starting basic of an officer in RBI is Rs.35150 /-
The starting basic of an officer in LIC is Rs.33745/-
The starting basic of an officer in Bank is Rs.23700/-

Basic Pay is crucial for everything including superannuation. Hence we request that it should be similar to that of the Central Govt. Officers as presented by the Pillai Committee.

Our other demands are:

i)Five Day Week
ii)Regulated Working Hours
iii)Child care leave for ladies with salary
iv)Crèche facility
v)Assured Pension etc.

Appointment of Officer Director / Employee Director. At present no Public Sector Bank has an Officer Director or Employee Director.

Implementation of the Recommendation of the Parliament Standing Committee on NPA. If the recommendations are implemented the entire Banking Industry can be saved. (Copy of the Report enclosed)

Please don’t levy tax on Gross Profit. The tax should be on net profit. RBI should provide interest on CRR which at present is almost one lakh crores. This will help the Banks.

Reimburse Expenditure on Govt Schemes. The expenditure on Jandhan, Pension Yojana and other Govt Schemes if reimbursed will help the Banks.

Stop Cross Selling: In the name of Universal Banking we have allowed Banks to sell insurance, Mutual Funds & other products. The huge incentive has lead to misselling. Please intervene. (Note Enclosed)

Review PCA: The 11 banks under PCA have not improved their performance. Hence a review is needed.

Review IBC & NCLT: Both have created lot of problems. They are not helping Banks but benefit the defaulters and new purchasers of the companies. Urgent steps are needed.

DISCUSSIONS WITH IBA ON 14.11.2017

One more round of discussions took place between IBA and our Workmen Unions yesterday i.e.14.11.2017 in IBA Office ain Mumbai.

IBA’s Sub-Committee was represented by Mr. Rakesh Sharma (MD, Canara Bank and Chairman of the Sub-Committee), Mr. V.G. Kannan(Chief Executive, IBA), Mr. B. Raj Kumar(Dy. Chief Executive, IBA), Mr. M.K Gupta(GM, Bank of India), Mr. Punit Jain(GM, PNB), Mr. T.S Seshadri(GM, Indian Bank), Mr. S.K Kakkar(Sr. Advisor, HR&IR, IBA) and Mr. K.S Chauhan(Advisor, IBA).

Our team was represented by Com. C.H. Venkatachalam and Com. B.S. Rambabu(AIBEA), Com. S.K Bandlish and Com. Vinil Saxena(NCBE), Com. Pradip Biswas(BEFI), Com. Subhash Sawant(INBEF) and Com. Upendrakumar(NOBW),

During the meeting, the following issues discussed in the meeting held on 3.11.2017 in the Sub-Group on demands relating to Disciplinary Action and Procedure were informed and further discussion took place.

i. For claiming travelling expenses for defending an employee in the departmental action, existing restrictions of ‘within the state’ be removed.

ii. Subsistence Allowance to be improved upon.

iii. Indiscriminate usage of Clause 5(j) to be stopped through proper guidelines / definition.

iv. Clarification with regard to provision of Clause 6(e) i.e. bringing down by two stages in the scale of pay and applicability of the same to employees who have already reached maximum in the scale of pay.

v. Clarification to be given that minor misconducts clearly enumerated under Clause 7 of BPS dated 10.04.2002 should not be brought as major misconducted under Clause 5.

vi. Multiple charges for one incident should not be made out.

vii. Punishment order by the Disciplinary Authority not to be implemented till the final disposal of Appeal by the Appellate Authority.

viii. Issuance of charge sheet under Pension Regulation to Award Staff after retirement to be stopped since it is not provided in Bipartite Settlement.

ix. Awarding the punishment of stoppage of increments should be without affecting superannuation benefits, as in the case of Officers.

x. Provision for appeal against suspension.

xi. In case of punishment of dismissals, a provision for Review Authority after Appellate Authority.

xii. Deletion of Fine as a punishment.

It was decided that the conclusions on the discussion on these issues would be finalised in the next meeting.

Thereafter, the following issues were taken up for discussions:

– Simplified formula for calculation of overtime wages. Unions submitted their views and the issue would be discussed further.

– On the issue of introduction of Leave Bank providing for voluntary contribution of leave by the employees to a common pool and utilisation of the same for sanctioning leave to those employees who suffer from major diseases and prolonged illness and have not leave to their credit, Unions submitted their Note containing their views and explained their proposal. It was decided to discuss the issue further.

– On our demands like Child Care Leave for women employees, Sabbatical Leave, Study Leave, etc., it was agreed that Unions would submit a Note for further discussion.

We pointed out that considerable time has elapsed since commencement of the discussions in May, 2017 on our Charter of Demands, but so far IBA has not come forward with their offer on wage increase and hence demanded that the next meeting of the Full Negotiating Committee should be fixed up at the very earliest for this purpose.

WAGE REVISION – SECOND ROUND.

EXCHANGE OF CHARTER OF DEMANDS.

As you aware that the owners are anxious to settle the wage revision which is due from 1.11.2017, and to achieve this goal there were communications to the Bank managements time and again. Prior to Nationwide strike exclusively by Bankmen on 28th Feb, 2017, officers’ organisations had submitted the broad summary on 20/02/2017 to IBA. Following the submission, at Chennai, on 19th April, 2017, a meeting was held, in which, Com.Alok Khare, Com. M.A.Srinivasan, Com. V.Ramabhadran , Com.G.Gunasekaran and the undersigned participated in the exercise. It was the past practice to submit the Charter of demands of officers and workmen together, but, on 2nd May, 2017, it was not possible.

In the meanwhile, to fine tune the COD, once again, a meeting was held on 1/06/2017 at INBOC office at MUMBAI, in which Com. Alok Khare, Com. V.Viswanathan and the undersigned participated.

IBA has invited the negotiating unions for a discussion today at IBA office to take the wage talks further. Chairman of the IBA Negotiating Team, Shri.R.K.Thakkar, (UCO) Smt. Usha Ananthasubramanian, (Allahabad Bank), Shri.Prashant Kumar (SBI), Shri.V.G.Kannan, CEO IBA, Shri.Rajkumar Dy.CEO, Shri.K.S.Chauhan Vice President HR & IR, besides the members of HR Dept of IBA. CEO, IBA initiated the proceedings of the meeting and handed over the forum to Chairman, Negotiating Team, for taking the discussion further.

After the exchange of the CODs by Officers and Workmen organisations with IBA and the IBA handing their list of demands, Chairman Negotiating team expressed that the time line mentioned in the earlier meeting should be kept in mind, present health of Industry and also the negotiations for officers shall be restricted upto Scale III. He further placed the periodicity of meeting will be every month. While supplementing the views of IBA, Smt. Usha Ananthasubramanian, emphasised that there should be a forward movement at the conclusion of the every meeting.

Reacting to the observations made, representatives have expressed that the expectations of the workforce should be fully addressed, de-stressing of the workforce should be carried out, health of the industry is not on account of the wage cost, negotiations cannot be restricted upto Scale III, residual issues of last wage revision exercise to be resolved viz., Regulated working hours, Discipline and Appeal Regulations, Accountability Policy, 5 days a week, issues of retirees- record note, officer representatives in the Banks’ boards, comparison of wages with Pay commission, unilateral introduction of service condition by a bank, Number of representatives to be allowed to participate in the negotiation, protection from cyber-crime, and problems encountered by the employees in the Insurance backed hospitalisation scheme etc. The meeting lasted for nearly an hour. The representative of the Officers’ organisations have handed over a letter addressed to Chairman IBA pertaining to the restriction stipulated by IBA.

MANAGEMENT ISSUES:
[1] C2C concept to be brought in;
[2] Rationalisation of Special Pay carrying posts.
[3] Review of the two graduation increments;
[4] Transfer and deployment of workmen staff;
[5] Simultaneous conduct of departmental and judicial proceedings for workmen;
[6] Conducting the departmental proceedings after retirement of workmen;
[7] Premature retirement of workmen;
[8] Outsourcing of any activity within the RBI guidelines;
[9] Review of the automatic movement of officers from Scale I to II and also Scale II to III ;
[10] To mark lien on NPS fund of employees to recover loss to the Bank on account of their proved misconduct.

UFBU meet-Post discussion with IBA: Subsequently, the representatives of nine unions met and discussed the issues confronting the Industry as well as the collective approach on the wage revision. The meeting lasted for nearly 90 minutes with the decision to meet on a mutually convenient day for a detailed discussion to chalk out the future course of action to “Save the Banking Industry” and also “halt the attacks on jobs and job Security”.

Awaiting for the forward movement for a collective, consensus and also achievable plan of action.

BOTTLENECKS IN THE COMMENCEMENT OF SALARY REVISION NEGOTIATIONS IN BANKING INDUSTRY

We are sorry to bring to your kind notice that even though the Government of India has been insisting for an early salary revision settlement at the industry level between the Indian Banks Association and the United forum of Bank Unions, there has been an unnecessary delay due to certain avoidable difficulties created by the Management of few banks in the Banking industry. It is historical that the salary revision in the Banking industry takes place once in 5 years through bilateral negotiations between the associations/unions and the Indian Banks Association covering over 10 lac workforce in the entire banking industry. During the last five decades we have concluded 10 bipartite settlements and the 11th one is now expected to take off. The first round of meeting was held between the IBA and the constituents of the United Forum of Bank unions on 2nd May, 2017 but without any concrete progress. One of the major hurdles that we are now encountering is in respect of the ‘mandate’ to be given by the member banks to the Indian Banks’ Association. A few of the banks have given a conditional mandate creating a chaotic and confusing situation in the negotiations, by insisting that they are allowing mandate for discussions only upto officers of scale III and that the remaining scales will have to be left to the discretion of the Bank.

2. The Banking Industry is overwhelmingly under the control of the Government of India due to the historical decisions taken by the Government of India during 1969 and 1980. The Nationalization of Banks was in the best interests of the economy and to take Banking facilities to the nook and corner of the country. We have seen the great contribution made by the banks during the last several decades due to this consolidation and ownership by the Central Government. But there was one area which was causing serious industrial relations crisis in the Banks at frequent intervals. Different banks had different service conditions and compensation system creating serious problems in the area of HR management. It was at this stage that the Government of India appointed Pillai Committee for the purpose of standardization of the scales and grades and also to bring parity amongst the Public Sector banks. After a thorough study of the service conditions that existed in those days, the Pillai Committee submitted a comprehensive report aiming at standardization and uniformity in the service conditions of the Officers in the Banking Industry. Thereafter, the Government of India introduced the recommendations of the Pillai Committee in the Banks for ensuring standardization and parity amongst the Public Sector Banks. Thus, a well-developed pattern was established over the next rounds of bipartite system in carrying forward the attempts made by Pillai Committee for the purpose of standardization of the salary scales and compensation system in the Banking industry. The Pillai Committee had recommended 4 grades and 7 scales which has now become a regular feature in all the Public Sector banks including the State Bank of India.

3. The Officers’ organizations have been negotiating with the Indian Banks Association in respect of all these 7 scales over the last several bipartites. Thus, the industrial relations have been cordial and harmonious as far as the salary structure and compensation systems were concerned as they were being discussed and settled through bilateral negotiations at the industry level. The present decision of some of the Banks, in particular the bigger Banks, seem to create a similar disparity which was prevailing earlier to distort the broad parity that is prevailing in the banking industry by attempting to retain the right of decision in regard to the scale IV and above in the banking industry. This will defeat the very purpose of the Pillai Committee’s attempt in ensuring parity and the subsequent objectives of the bilateral settlement.

4. We have conveyed our sentiments to IBA in our informal discussions and have requested them to ask all the Banks to give an unconditional mandate for negotiations on all scales rather than restricting it up to scale III alone. We therefore request your kind intervention in the matter so that the issue could be resolved without any further escalation on this issue which may affect the smooth conduct of negotiations.
Please treat the matter as urgent.
