Revision of rates of allowances to the teachers and equivalent academic staff working in University and Colleges.

The recent office memorandum said, the revision of rates of allowances to all teaching and non teaching staff, Registars, Finance Officers and Contraoller of Examination in Universities and Colleges as per the recommendations of 7th Central Pay Commission in Central Universities and Colleges thereunder and Deemed to be Universities whose maintenance expenditure is met by he University Grants Commission (UGC).

The date of revision of all allowances of 7th CPC is with effect from 1.7.2017.

Fixation of Pay – Clarification Note issued by MOD (Finance)

“The option for fixation of pay in the revised pay structure after the date of notification of CCS(RP) Rules 2016 cannot be exercised.”

MoD (Finace) may please refer to their notes at p.9-10/n in File No.12012/2/2016-AG/PB seeking clarification of this Department as to exercising of option for fixation of pay by the Government Servants in 6th CPC Pay Structure till their promotion which falls after the date of notification of CCS(RP) Rules 2016 (i.e. 25.7.2016).

2. The above matter has been examined in this Department. It is clarified that the option for fixation of pay in the revised pay structure after the date of notification of CCS(RP) Rules 2016 cannot be exercised, as Rule 5 of the said Rules provides for option only for promotion taking place upto 25.07.2016 (Date of Notification of the said Rule).

3. This issues with the approval of Joint Secretary (Personnel).

Subject: Implementation of CCS (RP) Rules, 2016 – Exercising of option for fixation of pay

This is regarding exercising of option for fixation of pay in the revised pay structure in terms of following provisions of CCS (RP) Rules, 2016:

Para 5 Save as otherwise provided in these rules, a Governments servant shall draw pay in the Level in the revised pay structure applicable to the post to which he is appointed.

Provisio 1: Provided that a Government servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increments the existing pay structure or until he vacats his post or ceases to draw pay in the existing pay structure.

Provisio 2: Provided further that in cases where a Government servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Government servant may elect switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.

2. Regarding the aforesaid provision, clarification was sought from Ministry of Finance/Dept. of Expenditure on the issue of exercising of option for fixation of pay by the government servants in 6th CPC Pay Structure till their promotion which falls after the date of notification of CCS (RP) Rules, 2016 (i.e. 25.07.2016).

3. Now, MoF(DoE) have issued clarification dated 19.03.2018 (copy enclosed) wherein it has been clarified that the option for fixation of pay in the revised pay structure after the date of notification of CCS (RP) Rules, 2016 i.e. 25.07.2016 cannot be exercised as Rule 5 of the said Rules provided for option only for promotion taking place upto 25.07.2016 (date of notification of the said Rules)

4. The clarification guidelines mentioned in para 3 above may please be adhered to.

Subject: Policy for retention of lien on appointment of below Board level employees of Central Public Sector Enterprises (CPSEs) to Board level posts in CPSEs

The undersigned is directed to refer to this Department’s O.M. No. 23(9)/93-GM dated 31.1.1994 and O.M. No. 23/19/98/GL-014/DPE(GM) dated 13.1.1999 on the subject cited. It provides that below Board level employees of CPSEs be permitted to retain lien on their below board level post for a period of 5 years when they are selected and appointed to Board level posts in same or other CPSEs.

2. In modification of above O.M.s, the Government has decided that “the period of lien shall be deemed to have been uniformly extended from the existing five years to six years in case where the Board level appointee in a CPSE was holding a lien on a below Board level post in CPSE”.

3. All administrative Ministries/Departments are requested to direct CPSEs in their jurisdiction to comply with the above mentioned decision.

Subject:- Procedure to process cases to accord exemption for air travel in airlines other than Air India in individual cases – Regarding.

Reference is invited to Department of Expenditure OM. No.19024/1/2009-E.IV dated 07.06.2016 on the subject cited above. In this context it is observed that a considerable number of cases in connection with travelling on official tour/LTC in private airlines (other than Air India) are being received for according post-facto approval. Availing the services of private airlines and subsequently seeking post-facto relaxation/approval is not a healthy practice.

2. With a view to avoid/the following procedure is prescribed for travelling on official tour/LTC:-

(a) Officers should prepare tour programme sufficiently in advance and tickets for Air India be booked.

(b) The guidelines issued by the Ministry of Finance for relaxation to travel by airlines other than Air India must be adhered to and request for relaxation be submitted at least seven (7) working days in advance from the date of travel.

(c) The tickets in either case should be booked either from the website of the Airlines or through the authorized agents nominated by the Ministry of Finance.

(d) Proposals for according post-facto approvals will not be entertained. However, in deserving cases, the proposal may be submitted with full justification for not obtaining prior approval.

3. The contents of this Circular may be brought to the notice of all concerned.

(a). In the current financial year, the Centralized Processing Center (CPC) of the Income Tax Department, Bengaluru has taken on an average 43 days to process the income-tax returns of Assessment Year 2018-19. Separate data of average time taken in respect of returns involving claim of refund is not available. However, 83% refunds in the current financial year were issued by CPC within 60 days of filing of return.

(b). Out of all eligible refund claims filed in FY 2017-18, CPC has already processed 1.93 Cr cases. Out of the total eligible refund claims pending as on 01.04.2018, only 1.86 Lakh are pending to be issued by CPC as on 24.07.2018. Processing for eligible refund claims filed in the current financial year has already been completed in 17.92 lakh cases and processing in 19.61 lakh cases is under progress. Eligible refund cases are those cases where the return of income is free from any defect, the response of taxpayer to any notice for adjustment of income or outstanding arrears is not pending and the case is not covered under scrutiny.
