Discontinuation of Overtime Allowance

In Rajya Sabha on 27.6.2019 Minister Dr.Jitendra Singh answered to a question in a written form about the Overtime Allowance for Central Staff as follows…

“In pursuance of the recommendations of the 7th Central Pay Commission, the Government has decided to discontinue overtime allowance for categories other than operational staff and the industrial employees governed by statutory provisions, w.e.f. 1.7.2017.

what says 7th CPC on Overtime Allowance?

The 7th Pay Commission has recommended to discontinue Overtime for all categories of CG employees other than Operational Staff and Industrial Employees who are governed by statutory provisions may be accepted.

Operational Staff:

All non-ministerial non-gazetted Central Government servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.

The concerned Administration Wing of the Ministries / Departments will prepare a list of operational Staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff with the approval of IS (Admn.) and Financial Adviser of the concerned Ministry / Department.

Conditions for OTA:

The grant of OTA may be linked to biometric attendance subject to the conditions mentioned below.

a) OTA should be paid only when his/ her senior officer directs the concerned employee(s) in writing for staying back in office to attend urgent nature of work.

The OTA will be calculated on the basis of biometric attendance.

The OTA for Staff Car Drivers should be linked with biometric system as normally, the designated parking is allotted in the office building. However, in cases where the parking lot is provided far from office, the Staff Car Driver would mark his/ her attendance while leaving from his office and a grace time of not exceeding 2 hours should be allowed to cover the distance travelled after leaving office, including the time to drop the officer and then reaching the parking lot. In such cases, calculation can be done from log books, duly verified by the officer concerned.

The OTA to field officials should be calculated on the basis of biometric attendance, as normally, such officers are given facility of official transport to attend the field work. Such officers are supposed to report in office before proceeding to field. In cases, where officials are required to attend the field work directly from home, they may be extended facility of official transport from home in lieu of transport allowance and OTA may be given on the basis of the log book of that vehicle, duly verified by their senior officers.

Revision of OTA Rates:

Since, the Government has decided not to revise the rates of OTA, the rates as prescribed in this Department’s OM dated 19th March, 1991 for Office Staff, Staff Car Drivers and Operative Staff will continue to operate subject to their fulfillment of the above conditions.

These instructions will be applicable with effect from 01 July, 2017

Subject : Cabinet’s decision on Allowance to central Government Employees.

Dear Comrade,

After the decision taken by the Cabinet on the Lawasa Committee’s recommendation on the CPC Allowances including HRA, there is a total discontentment amongst the Central Govt. Employees. The Govt. assured NJCA that within 4 months they will settle all the 7th CPC related demands. However the Govt. made the Central Govt. Employees to wait for more than an year and ultimately has decided to implement what the 7th CPC has recommended with some minor changes here and there. The demand of the NJCA and Staffside to revise the Allowances from 1/1/2016 has been rejected and Govt. has decided to revise the same only from 01/07/2017, thereby denying the arrears on Allowances to the Central govt. Employees.

The Govt. is remaining silent on the demand of minimum pay, fitment factor and NPS. The Govt has already rejected the option No.1 recommended by Th CPC to the pre-2016 pensioners.

In this situation this Federation is of the view that you may urgently call a meeting of the NJCA or Staff Side to discuss the entire issue and to take decision on future course of action considering the anger, dissatisfaction and discontentment amongst the Central Govt. employees. We hope you will appreciate the seriousness of the situation.

We are in the process of Preparing Transport Allowance Ready Reckoner to know the amount of TA to be paid in 7th pay Commission.

In our previous Post, [ See ]We have brought one issue to the light that the Government Servants placed in Level 1 and Level 2 and Pay in PB equivalent to 7440 and above in Sixth CPC will be getting less amount of Transport Allowance in 7th CPC than 6th CPC.

Transport Allowance Rates in Sixth CPC

There were Five Grade pay Levels in PB-I ie Rs.1800, Rs.1900, Rs.2000 and Rs.2400 and Rs.2800 All these GPs were brought under one Group for Transport Allowance at Lower rate, subject to not exceeding Rs.7440 Pay in the Pay band

In Sixth CPC those who were in the category of GP below 4200 and Pay band below 7440 were entitled for TA only at the Rate of Rs.600+DA for A1/A cities and Rs.300+DA for other cities. But The sixth CPC had relaxed the condition for this Group to get Transport Allowance at the next higher rate of Rs.1600 for A1/A cities and Rs.800 for other cities. Those who Reached the Rs.7440 PB level and above were entitled for the above-mentioned rates.

Groups realigned for Higher TA rates

Now, the 7th CPC might have thought that there is no point in Keeping the GP 2000, GP 2400, GP 2800 Levels at Lower TA rate, as they would become entitled for next higher rate of Transport Allowance at the initial stage itself. So it was a wise decision to bring them into the Group that is eligible for Transport Allowance at the rate of Rs.3600 +DA [Higher TPTA Cities] and Rs.1800+DA [other Places] in 7th CPC.

But, though the lowest Two Grade Pay Levels (Pre-Revised Rs.1800 GP and 1900 GP) are made eligible for TA @ Rs.1350+DA [ Higher TPTA Cities] and Rs.900+DA [Other Places] in 7th CPC, there are cases that some Govt Servants those were in 1900 GP and crossed 7440 were drawing TA at the rate of 1600+DA in Sixth CPC. Now they will be entitled for TA at the rate of Rs.1350+DA in Seventh CPC.

Transport Allowance Ready Reckoner Coming soon

So it will be useful, if Transport Allowance Ready Reckoner for both Sixth CPC and 7th CPC is available. So that we can find the difference between amount of TA in Revised and Pre-Revised Rates. We are currently in the process of finalising Transport Allowance Ready Reckoner. We will publish the 7th CPC TA Ready Reckoner as soon as possible.

Press Note – The Union Cabinet chaired by the Prime Minister Shri Narendra Modi approved the recommendations of the 7th CPC on allowances with some modifications.

PRESS NOTE

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi approved the recommendations of the 7th CPC on allowances with some modifications. The revised rates of the allowances shall come into effect from 1st July, 2017 and shall affect more than 48 lakh central government employees.

While approving the recommendations of the 7th CPC on 29th June, 2016, the Cabinet had decided to set up the Committee on Allowances (CoA) in view of substantial changes in the existing provisions and a number of representations received. The modifications are based on suggestions made by the CoA in its Report submitted to Finance Minister on 27th April, 2017 and the Empowered Committee of Secretaries set up to screen the recommendations of 7th CPC.

Sub:-Pay fixation to Running Staff while granting financial upgradation in the identical Grade Pay (VI CPC) under MACPS – Reckoning Special Running Staff Allowance for pay fixation-reg.

The undersigned is directed to refer to NFIR s letter No. IV/MACPS/Part 10, dt. 16.05.2017 on the above subject and to state that tile instructions for fixation of pay at the time of grant of financial upgradation under MACPS are contained in Para-4 of the Annexure to Board’s letter dt. 10.06.09 (RBE NoA 01/2009) which stipulates as under:-

 “Benefit of pay fixation available at the time Df regular promotion shall also be allowed at the time of financial upgraiation under the Scheme. Therefore, the pay shall be raised by 3% of the total pay in the Pay Band and the Grade Pay drawn before such upgradation. There shall, however, be no further fixation of pay at the time of regular promotion if it is in the same Grade pay as granted under MACPS”.

In view of the above, nodal Branches for 6th  & 7th CPC viz. PC-VI and PC-VII, have been consulted. They have advised that the Additional Allowance/Special Running Staff Allowance is not reckoned for fixation of pay on promotion. As such it is not feasible to reckon the same for pay fixation purpose while granting financial upgradation under MACP Scheme.
