Filing returns of assets and liabilities : Last date extended to 31.07.2016

Asset Amendment Rules 2016 – Extension of Last Date from 15th April 2016 to 31st July 2016 for filing returns for the year 2014 and 2015 under section 44 of Lokpal & Lokayuktas Act, 2013

Subject: Declaration of Assets and Liabilities by public servants under section 44 of the Lokpal and Lokayuktas Act, 2013 – filing of Returns by public servants Extension of last date – regarding.

The undersigned is directed to refer to this Department’s O.M. of even number dated 28th March, 2016 on the subject mentioned and to say that the last date for furnishing of declaration / information / annual return as on 01.08.2014 and 31.03.2015 relating to assets and liabilities by public servants under section 44 of the Lokpal and Lokayuktas Act, 2013 has been extended upto 31.07.2016. This would result in aligning the furnishing of all the three returns ( as on 01.08.2014, 31.03.2015 and 31.03.2016), on or before the 31st July, 2016. In this regard, a copy of Gazette Notification dated 11th April, 2016 is enclosed. Now the timelines for filing these returns are:-

i. The first return of assets and liabilities as on 1st August, 2014 under the Lokpal and Lokayuktas Act, 2013 – on or before the 31st July, 2016

ii. The next annual return of assets and liabilities as on 3lst March, 2015 under the Lokpal and Lokayuktas Act, 2013 – on or before the 3lst July, 2016.

iii. The annual return of assets and liabilities as on 31st March, 2016 under the Lokpal and Lokayuktas Act, 2013 should be filed on or before 31st July, 2016.

iv. The annual return for subsequent years as on 3lst March every year should be filed on or before 3 lst July of that year.

2. All Ministries/Departments and cadre authorities are requested to kindly issue order towards ensuring compliance of above timelines by all officers and staff in the respective Ministry/Department/Organizations/PSUs etc. under their control.

OFFICE MEMORANDUM

Subject: Immovable Property Return the year 2015 (as on 31.12.2015)

The undersigned is directed to refer to this Departrnent’s Office Memorandums of even number dated 21.12.2015 and 18.01.2016 on the subject cited above (available at persmin.nic.in -> DOPT -> Central Secretairat -> CSS -> Property Return).

2. A large number of CSS Officers have not yet submitted the Immovable Properly Retun for the year 2015 on 31.12.2015). As already informed, IPR should be submitted by all CSS officers through the Web Based Cadre Management System which is hosted at cscms.nic.in. However, as large number of officers are accessing the system, it has become slow making it diflicult to submit the return online. As the system is web based, officers may try filing IPR beyond office hours when the system is less congested. If it is still not possible to file the return online for any reason, they should file the return in paper format to their offices by the stipulated date i.e. 31.01.2016. They may subsequently file the same through cscms.nic.in.

Subject: The Lokpal and Lokayuktas Act, 2013- Submission of declaration Of assets and liabilities by CSS officers for each year- regarding.

The undersigned is directed to refer to this Department’s O.M. of even number dated 9.4.2015, 23.04.2015 and 16.7.2015 regarding declaration of
assets and liabilities by CSS officers under the Lokpal and Lokayuktas Act, 2013 and to state that vide Notification dated 27.04,2015 the last date for filing of returns by public servants as on 1.8.2014 and as on 31.3.2015 been extended to 15th October, 2015.

2. All CSS officers are requested to file the returns as on 1.8.2014 and for the year 2015 (as on 31.3.2015) online at cscms.nic.in at the earliest without
waiting for the last date to approach to avoid rush and slowing down of the system at the last moment. All officers of US and above levels of CSS should also take a print out of the return filed online and submit to this Department duly signed.

3. Ministries/Departments are requested that the contents of this O.M, may be widely circulated among all CSS officers working under their control. They should also monitor and ensure that the returns are submitted by all officers within the stipulated period without fail through Web Based Cadre
Management System.

NOTIFICATION

New Delhi, the 3rd July, 2015

G.S.R. 536(E).—In exercise of the powers conferred by sub-section (1), clause (k) and clause (I) of sub-section (2) of section 59 read with section 44 and section 45 of the Lokpal and Lokayuktas Act, 2013 (1 of 2014), the Central Government hereby makes the following rules further to amend the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and -the Limits for Exemption of Assets in Filing Returns) Rules, 2014, namely:-

1. (1) These rules may be called the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Second Amendment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Rules, 2014 in rule 3, sub-rule (2), the following proviso shall be inserted, namely :-

“Provided further that the public servants who have filed declarations, information and annual returns of property under the provisions of the rules applicable to such public servants, shall file the revised declarations, information or as the case may be, annual returns as on the 31 81day of March, 2015, to the competent authority on or before the 15th day of October, 2015.”

G.S.R. 322(E).— In exercise of the powers conferred by sub-section (1) read with clause (k) and clause (l) of sub-section (2) of section 59, read with section 44 and section 45 of the Lokpal and Lokayuktas Act, 2013 (1 of 2014), the Central Government hereby makes the following rules further to amend the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Rules, 2014, namely:—

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Rules, 2014, in note 3, in the proviso to sub-rule (2), for the words “on or before the 30th day of April, 2015″, the words “on or before the 15th day of October, 2015″shall be substituted.
