Sub:- Non-settlement of GDS demands – Two days strike with Postal JCA – Reg.

I would like to draw your kind attention on the following issues of GDS. The entire GDS employees are very much agitated on the non-settlement of GDS demands for the last 4 months. Implementation of positive recommendations of Shri Kamalesh Chandra Committee made partial and so many other positive recommendations are yet to be implemented. Regarding the drawal of Combined Duty Allowance, Composite Allowance and Risk & Hardship Allowances are kept pending in many divisions for seeking necessary clarifications from the Directorate. Membership verification in GDS cadre has been stopped arbitrarily. Non-availability of proper net work connection in rural areas became tedious in the operation of RICT devices in BOs including IPPB. Drawl of benefit from SDBS to retired GDS even after 5-6 years became farce. Repeated requests to the administration through various forums became in vain.

In this background, we have no other option except to conduct a serious trade union action and AIPEU-GDS is decided to go for two days strike on 8th & 9th January 2019 along with Postal JCA (NFPE & FNPO) demanding to settle the following issues in favour of GDS.

1. Implement all positive recommendations of Shri Kamalesh Chandra Committee and grant civil servant status to GDS.

2. The recommendations of the GDS Committee should be implemented from 01-01-2016 regarding new wage scale for calculation of arrears.

3. All the recommendations on retirement benefits to GDS should be implemented from 01-01-2016. Consider perusal about the drawal of benefits from SDBS to the retired GDS in waiting since Jan, 2014.

4. Justified scale fixation to be granted to senior GDS as there are some anomalies while fixing the new wage scale caused drawal of lesser wage and meager benefit compared with new entrants.

5. Bring GDS under the purview of Gratuity Act as recommended by the GDS Committee up to Rs.5.00 laks w.e.f 01-01-2016.

6. Issue orders on the following recommendations as ensured in the minutes of the meeting dtd.31-07-2018 with GDS unions.

(a) Children Education Allowance
(b) Emergency leave to GDS
(c) Accumulation of Paid Leave to a maximum of 180 days
(d) Insurance Scheme
(e) Limited transfer facility
(f) Voluntary discharge scheme
(g) Qualifying service for LDCEs.

7.Restart the process of membership verification in GDS cadre as it was arbitrarily cancelled.

8.Combined Duty Allowance, Composite Allowance, Risk & Hardship Allowance should be granted to GDS as per the recommendations of the GDS Committee without any modification.

9.All vacant posts of Departmental cadres viz., MTS, Postman, MG allotted to the GDS should be filled up as and when the vacancy arises every year keeping in view of the age of GDS and cut-off date of the examination. Conditions like 3yrs / 5yrs minimum service may be relaxed and allow the suggestions made by the GDS Committee. Condition of possessing Driving License at the time of examination may also be relaxed.

10.Fill up all vacant posts in GDS cadre to avoid combination of duties in the back ground of RICT & IPPB rolled out in BOs.

11.Grant Pension to the promoted GDS to the Departmental cadres based on Supreme Court Judgement in SLP No. (C) 13042 of 2014.

12.Proper net work availability should be made in all rural areas after introduction of DARPAN in BOs.

13.Grant funds to draw all kinds of incentives liable to GDS viz., MNREGS, DBT Schemes, PLI/RPLI etc., pending for years in all Circles.

14.Necessary changes may be made in Rule-3A of GDS (C&E) Rules, 2011 in case of Rule-3A (i),(ii),(iii),(vii)&(ix) in favour of GDS in the changed pattern of working conditions in the BOs besides the recommendations of the GDS Committee.

15. Introduce Medical treatment facility to GDS as suggested by the GDS Committee.

NFPE CALLS UPON POSTAL EMPLOYEES TO MAKE 2019 JANUARY 8th & 9th TWO DAYS STRIKE – A GRAND SUCCESS

THE FOLLOWING IS THE EDITORIAL PUBLISHED IN ‘POSTAL CRUSADER’ THE OFFICIAL ORGAN OF NATIONAL FEDERATION OF POSTAL EMPLOYEES (NFPE)

IMPORTANCE OF JANUARY 2019 TWO DAYS STRIKE

National Convention of Workers organized by Central Trade Unions (except BMS), independent Federations and Associations viz; Central Government and State Govt. Employees, Banks, Insurance, Defence production employees etc, held at Mavlankar Hall, New Delhi on 28th September 2018, has decided to conduct two days nationwide strike on 8th& 9th January 2019. Earlier, Confederation of Central Govt. Employees & Workers, in its National Convention held at Hyderabad on 10th June 2018, has decided to go for one day’s nationwide strike on 15th November 2018, demanding settlement of 10 points Charter of demands of Central Govt. Employees, Pensioners, Gramin Dak Sevaks and casual/contract workers. In the changed circumstances, Confederation has decided to postpone the 15th November 2018 one day strike and to join the two days strike on 8th and 9thJanuary 2019 announced by the National Convention of Workers. There is no change in the 10 points charter of demands of Confederation adopted in the Hyderabad National Convention.

The declaration adopted in the National Convention of Workers held on 28th September 2018 has stated as follows:

“Government is dragging its feet on wage negotiations of public sector in bipartite settlement and 7th Central Pay Commission anomalies of Central Government employees. Four sub committees were formed by the Government to address several issues raised by Central Government employees (NJCA) such as scrapping of New Pension Scheme (NPS) review of Minimum wage and fitment formula, restoration of allowances and allowing option-I as one of the pension benefit formula. But nothing has been done.
The Central Government Employees organisations including the Defence and Railways have been planning united action against the betrayal of the Government and asserting their genuine demands including scrapping of New Pension Scheme. This National Convention extends full support to their struggle and upholds all their demands.”

Thus, the entire Trade unions (other than BMS) has taken serious view of the negative attitude of the Central Government towards the demands of Central Government employees and Pensioners and extended full solidarity and support to our struggle.

Unrest among the New Pension Scheme (NPS) employees is rising day by day. Those NPS employees who retired from service, in 2015 to 2018, after completing ten years’ service are getting a paltry sum of Rs.1000 to 3000 only as monthly annuity pension. How can a pensioner and his family live with such a megre amount as pension. This is equal to “No Pension”, Under the Old Pension Scheme (OPS) an employee who completed minimum ten yearsservice is eligible for 50% of last pay drawn as minimum pension.

Regarding increase in Minimum Pay and Fitment formula, the assurance was given to the NJCA leaders by none other than the Hon’bleHome Minister and Finance Minister on 30.06.2016. Two years are over but nothing happened. Government has replied in Parliament that, at present, there is no proposal for increasing Minimum Pay and Fitment formula. Thus the entire Central Govt. Employees are betrayed. Regarding Pensioners, the one and the only favourable recommendation of the 7th CPC i.e. Option-I, stands rejected by Government.

Three lakhs GraminDakSevaks of the Postal department conducted a heroic strike for sixteen days and finally Govt. was compelled to accept their demands.But while issuing orders, even though new pay scale recommended by the Kamalesh Chandra Committee is implemented, regarding arrears the Committee’s recommendation was rejected and modified by Govt. Some important recommendations like Children Education Allowance, Time bound three financial upgradations etc. are still pending. Regarding revision of wages of Casual Labourers, orders issued by Postal Directorate is yet to be implemented in some Circles and Divisions and their demand for regularisation is not considered favourably by Govt.

The situation in the country is deteriorating day by day. National economy including value of Indian currency, suffered serious setback due to pro-corporate, anti-labour and anti-people neo-liberal policies pursued by the Central Government, grievously impacting the livelihood of the working people and farmers.

The situation due to steep rise in petrol and diesel prices with cascading effect on increase in prices of all daily life utility items, especially food items, is resulting in torturous impact on common masses. The unemployment situation is getting aggravated with employment generation practically turned negative even in most labour-oriented sectors. The agricultural sector and farmers are in deep distress. The after-effects of demonitisation and faulty GST Continue to adversely impacting the deep crisis set in the fast-paced neo-liberal economic policies of the Government. Lack of job opportunities on the one hand and continued job losses, retrenchments, illegal closures on the other hand are imposing miserable condition on the ordinary families for their food, education of children and medical care of the sick and elderly, Aggressive move to sell the shares of the Public Sector undertakings and onslaught of privatization through various routes like outsourcing, PPP etc. is going on in full swing. The demand for universal social security with guaranteed pension has fallen on deaf ears.

Central Govt. not only refused to respond to the just and genuine demands of the organized agitation of working class, but has been continuing its aggression against the hard-won labourrights of the workers, employees and Trade Unions. It is in this background the entire working class of our country has decided to fight back the onslaught of the Govt. against the working class and peasants.

National Federation of Postal Employees (NFPE) has been in the forefront of the struggle against the neo-liberal policies of the Govt. especially against the negative attitude of the Govt. towards the Central Govt. Employees demands including Postal employees.

On January 8th& 9th, about 18 to 20 crores organized and unorganized workers will go on two days strike. NFPE HQ calls upon the entirety of Postal and RMS employees including Gramin Dak Sevaks and Casual, Part-time, Contingent employees to join the strike en-mass. It is a struggle for our survival.

Sub: Settling the issues of Gramin Dak Sevaks

Sir,
The all-India strike called jointly from 22nd May, 2018, by three Unions of Gramin Dak Sevaks, namely, AIGDSU, AIPEU-GDS and NUGDS, was only recently settled amicably and they were assured that their demands will be settled.

Unfortunately, what is being offered is much below what was agreed to in the said settlement and the employees are restless again.

Their demands are as follows, which we Central Trade Unions support and urge you to concede the same at the earlier.

Charter of Demands

1) GDS committee report as a whole be implemented with effect from 01st of January 2016.

2) Change the formula already adopted for calculation of arrears.

3) Change of upper limit of gratuity from Rs 1,50,000/- to Rs 5,00,000/-
(a) GIS limit should be enhanced to Rs. 5,00,000 with the supscription of Rs.500/-

4) 10% of the TRCA of the GDS should be recovered towards SDBS contribution and the Government to contribute equal share.
(a) And also EPF Scheme to be introduced to GDS as recommended by the GDS Committee. This was also recommended by the previous GDS Committee.

5) GDS should be granted 30 days paid leave in a year and the leave should be allowed to be carry forward subjected to the maximum of 180 days and provide encashment of the leave.

6) Grant Children Education allowance Rs 6000/- per child per Annam

7) Enhance composite allowance to the BPMs from Rs 500/- to Rs 1600/- Also grant composite allowance to ABPMs & GDS working in classified cities and the GDS working in Departmental Offices etc., wherever applicable.

8) GDS employees should be granted financial up gradation on completion of 12,24 and 36 years of service in the form of grant of additional increments.
(a) Point to point fixation to be ordered instead of bunching of TRCA scales.

9) Limited transfer facility to GDS on request should be relaxed. There shall not be any drop in wage scale on account of a request transfer. The transfer of GDS will be approved by Divisional head if the transfer is within the Division, by regional PMG if it is within the region by HOC if the transfer is within the Circle.

10) Voluntary discharge schemes for the GDSs’ 3 types of voluntary discharge schemes as recommended by GDS committee for the GDSs’ who are willing to quit the post before the discharge at the age of 65 years should be implemented.

11) All discharge benefits (retirement benefits) should be implemented retrospectively, w.e.f. 01 January 2016.

12) Put off duty may be averted by transferring the GDS to another place.

13) Incentive system should be abolished for India post payment bank (IPPB) work. Enhance the working hours of branch post office and GDS officials concerned after introducing the IPPB.

14) GDSs’ should be allowed to get discharge from the service on the last day of the month in which He/She attains the 65 years of the age.

15) All single handed branch post offices should be provided with one more hand to upgrade to double handed office.

16) Employees’ state Insurance (ESI) facility to be extended to Gramin Dak Sevaks wherever E.S.I dispensaries and hospitals are available the country.

Sub:- Observance of three phase countrywide agitationalprogramme by GDS JCA

Sir,
As you are aware non-implementation of positive and basic recommendations of kamlesh Chandra committee on G.D.S Employees viz., implementation with effect from 01st of January 2016, gratuity Revision, SDBS/pension, 30 days paid leave, Enhancement of composite allowance, financial up gradation on completion of 12, 24 and 36 years of service etc. has generated resentment and discontentment among the G.D.S employees. It is pertinent to mention here that although discussions were held at Directorate, I am sorry to state that no progress is observed so far on any of the issues. Under the circumstances we are compelled to observe three phase fast Programme of agitation.

The above three GDS Unions, JCA decided the following countrywide agitational programme to settle the charter of demands.

Agitational programmes:
1.25-09-2018 : One day country wide hunger fast infront of Divisional Offices

2.04-10-2018 : One day country wide hunger fast in front of Circle Offices.

3.10-10-2018 : One day massive hunger fast in New Delhi.
