OFFICE MEMORANDUM

Subject- Grant of additional HRA to the civilian employees of the Central Government serving in the States of North Eastern Region, Andaman & Nicobar lslands, Lakshadweep lstands and Ladakh.

Consequent upon revision of rates of House Rent Allowance (HRA)/additional HRA w.e.f. 01.07.2017 vide this Department’s O.M. No.2/5/2017-E.ll(B) dated 07/07/2017 and O.M. of even number dated 19.07.2017 respectively, it has been decided to grant additional HRA at old duty station w.e.f. 01.07.2017 to all those Central Government civilian employees who have been transferred to North Eastern Region, Andaman & Nicobar lslands, Lakshadweep lslands and Ladakh, prior to 01.07.2017 or after 01.07.2017 and continue to remain posted there after 01.07.2017, as under:-

Grant of House Rent Allowance (HRA) to Central Government employees as per 7th CPC – Finance Ministry Issued Orders on 7.7.2017Additional HRA for Civilian Employees of the Central Government serving in the States of North Eastern Region, Andaman & Nicobar Islands, Lakshadweep Islands and Ladakh – Finmin Orders dt.19.7.2017

(i) ln case of civilian employees of Central Government transferred to and posted from a date prior to 01.07.2017 who leave their families behind at the old duty station, the HRA of the old duty station will be calculated on the revised pay drawn on 01.07.2017 with the percentage rates of HRA effective on 01.07.2017 as per 0.M. No. 2/5/2017.E.ll(B) dated 07/07/2017.

(ii) ln case of civilian employees of Central Government transferred to and posted from a date on or after 01.07.2017 who leave their families behind at the old duty station, the HRA of the old duty station will be calculaled on the revised pay drawn on the date of transfer with the percentage rates of HRA etfective on the date of transfer.

Sub : Admissibility of House Rent Allowance in the event of non-acceptance or surrender of railway residential accommodation.

Ref : Board’s letters No. (i) No. E(P&A)II-87/HRA-15, dated 16-5-1988,
(ii) No. E(P&A)11-95/HRA-3, dated 14-2-1996,
(iii) No. E(P&A)11-99/HRA-2, dated 12-7-1999 & 16-3-2000,
(iv) No. E(P&A)II-2002/HRA-4, dated 16-10-2002,
(v) No. E(P&A)11-2002/HRA-4, dated 9-5-2003 and,
(vi) No. E(P&A)II-2010/HRA-2, dated 08-12-2010

Attention is invited to Board’s letters quoted above delegating powers to the General Managers and other Heads of Organisations directly controlling allotment of quarters to Railway Servants for sanction of House Rent Allowance in accordance with the prescribed conditions to the categories of Railway Employees specified therein. This delegation of powers was valid upto 31.03.2017.

2.The question of renewing this delegation of powers beyond 31.03.2017 has been engaging the attention of the Board. On the basis of the reports received from the Zonal Railways and Production Units, the matter has been considered and the Board have decided to renew the sanction contained in para 5 of their letter dated 16.5.1988 ibid and as amended/modified from time to time, w.e.f 01.04.2017 upto 31.03.2024 where after the question of renewing this delegation will be considered by the Board and a fresh sanction, if necessary, issued on the basis of reports received from the General Managers etc., directly controlling allotment of quarters, in regard to the position of availability of Railway accommodation under their control.

3. In case at any point of time it transpires that some accommodation is likely to remain vacant/un-occupied due to lack of demand, it should be made compulsory to submit applications for such types where there is surplus accommodation, and consequently, the employees entitled for such types would not be eligible to draw House Rent Allowance.

4. This delegation is also subject to the over-riding, condition that these orders are liable to be withdrawn/modified at any time during this period, if it is considered necessary by the Board to do so.

5. This has the approval of the President and issues with the concurrence of the Finance Directorate of the Ministry of Railways.

NOTIFICATION
New Delhi, the 1st January, 2018

G.S.R. 08(E).—In exercise of the powers conferred by the proviso to article 309 read with clause (3) of article 148 of the Constitution and after consultation with the Comptroller and Auditor-General of India in relation to the persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely–

1. (1) These rules may be called the Central Civil Services (Leave) Second Amendment Rules, 2017.

(2) They shall come into force on the dale of their publication in the Official Gazette. In the Central Civil Services (Leave) Rules. 1972 (hereinafter referred to as the said rules), in rule 54, in sub rule

(3), the words and subject to the other conditions laid down in rule 57 being satisfied, draw study allowance in respect thereof”‘ shall be omitted.

3. In the said rules, in rule 56,-
(a) in sub-rule ( for the words ‘House Rent Allowonce and Study Allowance as admissible in accoldance with the provisions of Rules 57 to 60. the words ” House Rent Allowance” shall be tedd.

4 THE GAZETTE OF INDIA EXTRAORDINARY [PART II—SEC. 3(i)]
(b) in sub-rule (4), the words “as envisaged in sub-rule (2) of Rule 57,” shall be omitted;
(c) sub-rule (5), shall be omitted.

4. In the said rules, rule 57, 58 and 59 shall be omitted.

5. In the said rules, in rule 60, in sub-rule (2), the words “and the Study Allowance” shall be omitted.

6. In the said rules, in rule 63, in sub-rule (1), in clause (i), the words “Study Allowance” shall he omitted.

Subject: Implementation of 7th CPC Recommendations for grant of House Rent Allowance (HRA) to Armed Forces Personnel.

Sir,
I am directed to say that consequent on the decisions of the Government on the recommendations of Seventh Central Pay Commission, the President is pleased to decide for grant of HRA to Armed Forces Personnel in partial modification of MoD letter No.10(55)/98/D(Q&C) dated 18th November, 2008 as amended from time to time that the admissibility of HRA shall be as under:

2. The list of cities/towns classified as X, Y and Z vide Ministry of Finance, Dept. of Expenditure OM No.2/5/2017- E.II(B) dated 7th July, 2017 for the purpose of grant of HRA is enclosed as Annexure to these orders.

3. The rates of HRA will not be less than Rs.5400/-, 3600/- & 1800/- at X, Y & Z class cities respectively.

4. The rates of HRA will be revised to 27%, 18% and 9% for X, Y & Z class cities respectively when Dearness Allowance (DA) corsses 25 percent and further revised to 30%, 20% and 10% when DA corsses 50%.

5. The term “basic pay” in the revised pay structure means the pay drawn in the prescribed pay levels in the Pay Matrix and does not include Non-Practising Allowance (NPA), Military Service Pay (MSP) etc. or any other type of pay like special pay etc..

6. Special orders on continuance of HRA at Delhi eX’ class city) rates to Central Government employees posted at Faridabad, Ghaziabad, NOIDA and Gurgaon, at Jalandhar (‘Y’ class city) rates to Jalandhar Cantt. at “Y” class city rates to Shillong, Goa & Port Blair and HRA at par with Chandigarh (‘Y’ class city) to Panchkula, S.A.S. Nagar(Mohali) which have been allowed to continue vide Para ‘4’ of MoF O.M. No.2/5/2014-D.II(B) dated 21.07.2015 and O.M. No. 2/2/2016-E.II(B) dated 03.02.2017, shall continue till further orders.

7. Other terms and conditions governing ERA to Armed Forces will remain unchanged.

8. The allowances relating to CILQ. FAA and SNLQ henceforth stand abolished as a separate allowance. Eligible employees to be governed by the newly proposed provisions for Housing for Personnel Below Officers Rank (PBORs).

9. The revised rates of the above allowances Vi/ill be effected from 1st” July, 2017.

10. This issues with the concurrence of the Ministry of Defence (Finance/Works) vide their ID No.363/Fin/W-II/17 dated 10.10.2017.

House Rent Allce. Matrix for House Rent Allce has been introduced. The Matrix is given below:-

An employee with dependents, during field posting or staying in Barracks as functional requirement will be eligible for accommodation for his dependents anywhere in the country.

* Provided government accommodation is not available for the dependents at Selected Place of Residence. If government accommodation is available, no HRA is payable.

** Reduced HRA means rate of HRA applicable reduced by 5 percent. However, the reduced amount cannot be less than the lowest rate of HRA applicable to Class Z cities/towns. Allowance is available provided employee is required to stay in barracks as a functional requirement and government accommodation is not available for the dependents at Selected Place of Residence. If employee is staying in barracks by choice or government accommodation is available at Selected Place of Residence, no HRA is payable.

@ Reduced HRA means rate of HRA applicable reduced by 5%. However, the reduced amount cannot be less than the lowest rate of HRA applicable to Class Z cities/towns. Allowance is available provided employee is required to stay in Barracks as a functional requirement. If employee is staying in Barracks by choice, no HRA is payable.
