Please find enclosed copy of reply dated 22/03/2019 received from the Railway Board on Federation’s demand dated 30/11/2018. The Federation has, however, wrote back to the Railway Board on 01/04/2019 contending that the entitlement of higher class privilege pass to those in lower pay levels was allowed without any dilution till December 2010, therefore the right of the employees for higher class privilege pass entitlement should have been continued as was done in the past despite issuance of revised entitlements vide Board’s letter dated 06th January, 2011. However, Board’s response on Federation’s letter dated 01’st April, 2019 has not yet been received.

Copy of Federation’s letters dated (30/11/2018 & 01/04/2019) are enclosed to facilitate the affiliated Unions to convey at field level the efforts initiated by NFIR for getting higher class privilege pass entitlement to those employees who are in the below GP 4200/Pay Level-6 in Railways and entitled for higher class privilege pass as per their Basic Pay but for Board’s order dated 06th January, 2011.

Affiliates attention is invited to NFIR’s letter No. IV/ NFIR/7th CPC (Imp) Allowance 2016/Part Dated 08/04/2019 (10 Pages) wherein large number of categories for who Risk and Hardship Allowance is required to be extended has been covered.

Today the 1st Meeting of EDs Committee was held at Pragati Maidan (Railway Board’s Office) at 15:30 hrs in which NFIR President Shri Guman Singh participated. In the preliminary meeting, the Committee noted that NFIR has already sent its proposal covering large number of categories besides representations. However, the Committee decided that the Federations may give further inputs/justification, covering remaining categories for whom Risk and Hardship Allowance is required to be granted. The next meeting of the Committee may take place during the 1″ week of May,2019.

The affiliates are, therefore, advised to please go through the contents of Federation’s proposal dated 08th April, 2019 and furnish categories if any, which are required to be included with proper justification for the purpose of proposing to bring them within the ambit of Risk and Hardship Allowance. Affiliates may please note that they should avail this opportunity to give full details with regard to the element of Risk and Hardship involved in various other categories also so that fruitful deliberations can take place for preparing final report with positive recommendations for bringing all such categories within the ambit of Risk and Hardship Matrix according to the gravity of Risk and Hardship of each category.

The inputs/suggestions/proposals should reach Federation’s Office latest by 25th April, 2019, treating this as priority item. Adequate publicity should also be ensured on the contents of Federation’s proposal dated 08/04/2019 to the EDs Committee.

Sub: Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission – Revision of pension of pre-2016 pensioners/family pensioners etc-reg.

Ref: Railway Board’s letter No. 20161F(E)III/1(1)/7 dated, 22/05/2017.

Kind attention of Railway Board is invited to the instructions issued vide letter dated 22/05/2017 (RBE No.49/2017 and PC-VII No. 20/2017) wherein a copy of Department of pension and Pensioners’ Welfare (DoP & PW)’s O.M. No.38/37/2016-P&PW (A) dated 12th May, 2017 on the above cited subject was forwarded with direction that these instructions apply mutatis and mutandis on the Railways also.

It has been brought to the notice of the Federation by the Railway pensioners/family pensioners that the orders issued by the DoP & PW Railway Board vide O.M. dated 12th May, 2017/letter dated 22/05/2017 are disadvantageous to those pensioners who were drawing compulsory retirement pension or compassionate Allowance due to the reason that pension revision in their favour has been denied vide Para 11 of O.M. dated 12th May, 2017 while the said order permits revision for all other pre-2016 pensioners /family pensioners.

Further Federation desires to state that all the pensioners who retired before 01/01/2016, the revised pension/family pension w.e.f. 01/01/2016 has been granted with 2.57 multiplication as has been fixed at the time of implementation of 6th CPC recommendations. These orders were made applicable uniformly to all types of pensioners including family pensioners without any discrimination. However, on raising the issue by the Staff Side/JCM to revise the pension/family pension as per 7th CPC recommendation, the Government have conceptualized. new formulation of calculation of notional pay/notional pension and accordingly DoP & PW vide O.M. No. 38/37/2016- P&PW (A) dated 12th May, 2017 (Railway Board’s letter No. 2016/F(E)III/1(1)/7 dated 22/05/2017- RBE No. 49/2017) have issued instructions for revision of pension/family pension duly reckoning notional pay/notional pension w.e.f. 01/01/2016.

NFIR, further states that while the earlier order dated 04th August,2016 (para 4.1) issued by DoP&PW wad made applicable universally to all pensioner /family pensioners whether they retired on superannuation or voluntarily or retired compulsorily duly applying 2.57 multiplication factor, the revised orders of DoP&PW vide O.M. dated 12th May, 2017 for revision of pension/family pension on notional pay/notional pension w.e.f. 01/01/2016 have discriminated those pensioners who have been drawing pension having been compulsorily retired, is really unfortunate.

Federation is constrained to convey tryt the discrimination against a section of pensioners and denial of pension revision to them is not only arbitrary but also unlustinea which acfion may lead tp litigation’ Federation also reminds the Railway Board that in the past when the pension was revised from time to time pursuant to the recommendations of previous pay Commissions, such discrimination was never done and all the pensioners were treated equally.

NFIR & therefore, requests the Railway Board to kindly arrange to make out a case pursuant to this representation and approach DoP & PW for issuing modified instructions duly deleting para l1 of O.M. dated 12th May, 2017. copy of the proposal sent the DoP&PW may please be made available to the Federation for follow up action.

Sub: Upgradation of Junior Accounts Assistants GP 2800 to GP 4200 in Railways – Implementation of the VII CPC recommendations (Para 11.62.15)-reg.

In the Railways, the Junior Accounts Assistants are recruited from the open market through Railway Recruitment Boards. The Candidates with Graduation as qualification are required to face written examination conducted by RRBs and once short- listed, have to appear in an interview.’An examination in typing skills had also been introduced in Railways. Based on the combined marks secured in both the written examination and the interview, the RRBs assign them ranlg based on which the seniority is fixed and appointments given. The RRB rank goes a long way in determining the seniority in the panel for Appendix 3 IREM qualification and also in other examinations for selections to Group B Gazetted posts.

2. Tlie directly recruited JAAs through RRBs are compulsorily required to qualifu in the Appendix 2 IREM examination for their confirmation in the posts. If they fail in the Appendix 2 Examination in two attempts, they have no choice but to quit the job as their services will be terminated. lPara l7I(4) (iv) of IREM Vol. Il

3. The VII CPC has recognized the importance of App.2 and 3 IREM examinations while dealing with the Accounts Department pay structure. The Pay Commission has stressed the direct recruitment stage with Combined Graduate Level Examination (CGLE) in its report as placed below:-

“Para 11.62.14 of the VII CPC report:- It has been demanded that the pay scale of Auditor/Accountant may be upgraded from GP 2800 to GP 4200. It has been stated that the recruitment to the post of Auditor/Accountant is by promotion from Clerks/Typists under seniority quota, promotion under examination quota and direct recruitment through a Combined Graduate Level Examination (CGLE) conducted by the Staff Selection Commission. It has also been pointed out that their job profile demands greater audit/accounting skills which justify higher pay scale.”

Under Analysis and Recommendation, the VII CPC has stated the following:

“Para 11.62.15: The Commission notes the CGLE is held for recruitment for different posts in GP 2800, GP 4200 and GP 4600. This Examination consists of written examination and interview. A candidate is given the choice to appear only in the written examination” or both – written examinations and interview – depending upon the post for which he/she is an applicant Applicants who have to clear both the written examination as well as the interview are eligible for recruitment for posts carrying higher grade pays of GP 4200/GP 4600. Applicants who do not have to clear the interview and are selected only on the basis of written examinations are placed in GP 2800. Although Auditos/Accountants are selected through CGLE, they are selected only on the basis of written examination- The Commission, therefore, recommends replacement pay levels for Auditors/Accountants. “

4. In this connection, NFIR contends that since the VI CPC has recognized the Accounts Department of Indian Railways as belonging to ‘Organized Accounts’ alongside Audit & Accounts, the dispensation recommended for Audit & Accounts will have to be extended to the Accounts Department of Railways as well in the case of JAAs as their recruitment is also through CGLE-Combined Graduate Level Examination conducted by RRB (in the case of Audit & Accounts, it happens to be Staff Selection Commission and both recruitment Bodies are on similar pattern) followed by interview.

5. Therefore, the grade pay of JAAs in Railways needs to be upgraded from 2800 to 4200 pursuant to the analysis and recommendations of the VII CPC (Part 11.62.15). Consequently, since the present AAs are of GP 4200, the following structure should fall in place: JAA-4200, AA-4800, SSO(A)/Sr.TIA/Sr.ISA-5400 (It is relevant to note that GP of 4600 does not exist in the hierarchy of Accounts Department as per the Gazette Notification issued pursuant to VI CPC recommendation, while it is taken for the limited purpose of MACPS).

NFIR, therefore urges upon the Railway Board to take necessary action for upgradation of JAAs to GP 4200/Pay Matrix Level 6 and revise the pay structure of Accounts Department Cadre in Railways as proposed vide para 5 above.

Sub: Revision of percentage distribution of posts in Technicians category-implementation of agreement-reg.

On the Charter of Demands of the Federation, informal and formal meetings were held by the Railway Board, chaired by CRB, on 21st & 22nd July 2016 at Rail Bhavan, New Delhi.

On 22nd July 2016, the demand relating to merger of Technicians Grade-II (GP 2400/-) with Technician Grade-I (GP 2800/-) was discussed by the Board with the Federations. Consequently, it was agreed that the percentage distribution of Technicians category shall be revised as indicated below w.e.f. 01/09/2016, while merger issue will be processed separately.

In this connection, NFIR brings to the notice of Railway Board that in the wake of orders issued by the Railway Board for implementation of 7th CPC Pay Matrices and grant of option for switching over to revised pay, a number of representations being received at this, urging for implementation of the agreement to enable the employees to take a decision for exercising option for revised pay matrix. While the Federation is aware that the proposal is already under process, it may kindly be appreciated that expeditious action is required to be taken for issuing orders which would facilitate staff to exercise option for7th CPC Pay Matrix.

NFIR, therefore, requests the Railway Board (MS & FC) to kindly see that orders are issued at the earliest revising the percentages as above with effect from September 1, 2016.
