Dear Sir,

Sub: NFIR PNM pending items – quick redressal of issues – reg.

Although PNM meeting under your chairmanship was held on 25th & 26th April, 2019 and subsequently the pending PNM Items relating to PC-I Directorate were also discussed on 04th June, 2019 in a special meeting, many items are continued to remain unresolved. Many pending PNM Items can also be settled by issuing fomral orders as the demands are within the parameters of norms and logic.

NFIR has also sent fresh PNM Agenda to the Railway Board on 29th May, 2019 as the Federation is eager for formal meetings in quick succession for sorting out the staff grievances through serious dialogue. Some of the demands listed in the fresh Agenda can also be agreed to, straightaway and orders issued by Railway Board without waiting for discussion. The Federation’s request is that the PNM Items which can be agreed without waiting for formal discussion need to be identified and decisions communicated by the Board and this initiative would motive employees.

NFIR, therefore, requests your kind intervention to see that the Railway Board gives greater priority for resolving PNM Items soon.
Federation may kindly be replied of steps initiated on this specific proposal.

Non-grant of revised pension 7th CPC) to pre-2016 retirees – reg.
Ref: NFIR’s letter No. II/35/20l8 dated 08/09/2018

In view of difficulties faced for revision of pension (w.e.f. 01/01/2016 – 7th CPC) of retired Running Staff consequent upon non-reckoning of 55% add on pay element to retired Running Staff, 30% add on pay element for retired Loco lnspectors (pre-2016) and non-reckoning of ‘Charge Allowance’ granted to JA Grade Officers (worked on adhoc basis and retired) which is counted as pay for all purposes as per extant instructions, NFIR vide its letter dated 08/09/2018 requested the Railway Board to make adequate provisions in the ARPAN software to enable the zonal Railways tb redress the grievances of retired staff.

Along with its communication dated 08/09/2018, Federation also enclosed copies of Western Railway and Sourh Central Railway’s letters dated 06/07/2018 & 10/08/2018 wherein specific difficulties/problems faced by the zonal Railways were highlighted’ Federation feels disappointed that though a period of more than two months passed, neither.rectification in the software ARPAN has bleen don. no, Federation apprised of steps taken to mitigate problem.

While enclosing copy of Federation’s letter dated 08/0912018 (together with enclosures), NFIR once again requEstsifie Railway Board to kindly intervene to see that rectification in the software is ensured soon. Federation may please be apprised of the action taken in the matter.

Sub:- Mutual Transfer involving employees working in two different grades.

In terms of para 310 of IREM Vol. I 1989 Edition, Railway Servants can seek mutual transfer in the corresponding cadre of two Divisions/Offices/Railways and retain the seniority of the junior employees in their respective new units. The procedure for mutual transfer have recently been further simplified vide:-

(i) Board’s letter No. E(NG)I-2017/TR/24 dated 22.09.2017 (RBE No. 131/2017) which delegates powers to Divisional Railway Managers in respect of mutual transfer, and

(ii) Board’s letter No. E(NG)I-2017/TR/19 dated 06.07.2018 (RBE No. 99/2018) which enabled employees working in Level-I (GP Rs. 1800) belonging to any department/cadre to go on Mutual Exchange basis transfer with another employee working in Level-I (GP Rs. 1800) irrespective of cadre.

2. With a view to further enable employees to seek Mutual Exchange Transfer and in view of clarifications sought by some Zonal Railways in this regard and the demand of both and Federation e.g. NFIR and AIRF, Board have considered the matter. It has been decided that Mutual Transfers may also be permitted between staff in two different grades but only in the recruitment grade of the cadre and not in intermediate grades.

3. Both the employees seeking mutual exchange shall have to give a written undertaking accepting reversion unconditionally and willingly in their own interest to the recruitment grade and bottom seniority in their respective new Unit in order to avoid future litigation. The expression mentioned in preceding lines, should necessarily be incorporated in the application submitted by the employee concerned. The “Note” below para 2(b)(iii) of Board’s letter No. E(NG)I-2017/TR/24 dated 22.09.2017 as mentioned in para 1 above stands deleted.

4. Other terms and conditions for mutual exchange including community restrictions contained in Board’s letter No. E(NG)I-2004/TR/16 dated 14.08.2017 and 22.10.2007 remain.

Hon’ble Supreme Court judgement dated 15.09.2017 in the SLP(C) No.9574 of 2013 filed by All India Adiwasi Employees Federation against judgement dated 20.12.2012 of Hon’ble High Court of Bombay, Nagpur Bench- Appointment of candidates belonging to Halba Koshti/Halbi Koshti/Koshti etc., castes against vacancies reserved for the Scheduled Tribes.

“The impugned OM squarely makes the law laid down by the Apex Court applicable to all such appointment of the Halba/Koshti, which have become final on or before 28th November, 2000. The Hon’ble Court also held that rather than finding the said office memorandum to be unconstitutional or illegal; it is in consonance with the laws laid down in the judgment of the Apex Court.”

Railway Bonus 2018 – PLB for 2017-18 equivalent to 78 days wages will be declared Soon to railway employees

Railway Board informed in its letter to the Two railway federations NFIR and AIRF that a meeting would be held on 7.8.2018 to finalise about the Productivity Linked Bonus for the Financial Year 2017-18 to be paid in current year 2018.

But so far, no Federation has revealed the out come of that meeting. But it is believed that there will be no change in the Bonus amount for this year 2018 also.

For 2015-16 the productivity-linked bonus (PLB) equivalent to 78-day wages was paid in 2016 to Railway Employees.
