Fixation of pay on Non-Functional Upgradation from Level-8 to Level-10 with effect from 08.03.2018 and thereafter with effect from 1st January and 1st July of subsequent years (applicable for Non-Accounts Department Officers)

*While fixing the pay in Senior Scale promotional benefit has been as admissible.

** On grant of NFU w.e.f.08.03.2018, pay of the employees shall notionally be fixed in Level-10 at Rs.80000, thereafter the pay in Level-11 will be fixed at 80,900 in Level-11. The provisions of FR 22 (I)(a)(i) ie.Rule 1313(I)(a)(i) of IREC Vol.II would continue to be applicable on grant of NFU.

** In respect of Accounts Department Officiers, similar procedure may be followed for fixation of Pay on grant of Non functional Upgradation from Level-9 to Level-10 in respect of officials officiating in Sr.Scale (Level-11) prior to grant of NFU.

*** If the employee in this illustrations is drawing more pay than that computed due to fixation at Rs.80900, the higher pay of that employee in such circumstances shall be protected as “Personal Pay” till the date it is adjusted by the next increment.

Subject: Review of instructions on appointment to Non Functional Selection Grade of Organized Group ‘A’ Central Services-regarding.

Reference is invited to the Department of Personnel & Training (DoPT) Office Memorandum (OM) No. 28038/1/88-Estt.(D) dated 09.10.1989 & OM No. 28038/1/88- Estt.(D) dated 22.11.1990 regulating appointment to Non Functional Selection Grade (NFSG)
of organized Group ‘A’ Central Services and DPC Guidelines issued by this Department vide OM Nd1 22611/5/86-Estt.(D) dated 10.04.1989.

2. The provisions contained in OM dated 22.11.90 regarding calculation of vacancies in NFSG in respect of officers proceeding on long term deputation (more than one year) have been reviewed and it has been decided that the vacancies arising due to officers proceeding on long term deputations (more than one year) can be considered while calculating the total number of vacancies for grant of NFSG, subject to the following conditions:-

(i) as and when the officers return from deputation, the junior most officer (s) who has/have been granted NFSG will be reverted to JAG level and
(ii) the total number of posts in the cadre in NFSG at any point of time shall not exceed 30% of the Senior Duty Post (SDP). The OM dated 22.11.90 shall stand amended to this extent.

3. The suitability criteria for appointment to NFSG contained in OM dated 9.10.89 providcfs that the overall performance of an officer shall be good and he shall have at least two ‘Very Good’ gradings in the last five APARs/ACRs. This criteria has been reviewed and it has been decided that overall performance of an officer for appointment in NFSG shall be “Very good” i.e. 5 Very Good in the last five APARs. The OM dated 9.10.89 shall stand amended to this extent.

Subject: Grant of NFSG to UDCs of CSCS – regarding

The undersigned is directed to refer to this Departments O.M.No.20/49/2009-CS.II (B) dated 22nd June, 2011 vide which a new grade of UDC Non-Functional Selection Grade (NFSG) in CSCS in the Grade Pay of Rs.4200/- in Pay Band-2 was created with effect from 22.06.2011.

2. It has been decided in consultation with D/o Expenditure to operationalize the NFSG of Grade Pay of Rs.4200/- in the case of UDCs of CSCS. The cadre units are requested to grant Grade Pay of to 1104 UDCs figuring in the list attached as Annexure —l subject to their suitability with effect from 22.06.2011 till the date of their promotion as Assistants on ad-hoc basis / Retirement / Expired / VRS / resigned etc whichever is earlier. The cadre units are also requested that the cficiels who have already resigned I retired / taken VRS / Expired etc prior to 22.6.2011 may not be qranted the Grade Pay cf Rs. 420C/-. Further, those UDCs who have been promoted to the grade of Assistant on ad-hoc basis prior to the issue cf O.M. No. 20/49/201 -CS.!I (B) dated 226.2011, have been excluded from the list of beneficiaries.

3. While granting the Grade Pay of Rs. 4200/- the cadre units may follow the procedure laid down in sub-pera (ii) to (v) of para (b) of this Department’s OM. No.20/49/2009-CS.ll (B) dated 22 06.2011. The pay fixation may be done under Rue 13 of CCS (Revised) Pay Rules, 2008 and other relevant instructions on the subject. The financial implications would have to be met by the respective Ministries / Departments.

4. Cadre units are also requested to send a compliance report in the enclosed proforma (Annexure-Il) to CS.II Division, detailing the officers who have been granted NFSG, by 30.06.2015. Since the Select List of 2003 (Extended) of UDC grade is under litigation, the grant cf Grade Pay of Rs. 4200/- would be subject to the outcome of the SLP (Civil) No, 10342/2015 filed by Shri Pankaj Kumar Mishra and others before the Hon’ble Supreme Court and O.A, No. 794/2015 filed by Shri Kamal Kumar Gupta and others before CAT Principal Bench, New Delhi and also orders in any other connected matter by any competent authority. This may be Included in the orders to be issued by the Cadre Authorities.

5. M/o Finance, D/o Expenditure’s vide their ID No. 94952/2015/E-III (A) dated 01-06-2015 have concurred with the proposal.

6. In case of errors/omissions if any, the same may be brought to the notice of this Department immediately.
