Senior Citizen Entitlement of Employees

Will the Minister of

PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-

(a) whether the Government has worked out a plan to lower the age of senior citizen entitlement of employees to 58 years;
(b) if so, the details thereof;
(c) whether the Government is contemplating to increase or decrease the age for pension;
(d) if so, the details thereof and if not, the reasons therefor; and
(e) the details of salient features of pension policy?

ANSWER

MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (DR. JITENDRA SINGH)

(a) to (d): No Madam. Department of Social Justice & Empowerment has informed that there is at present no proposal in that Department for lowering the age of senior citizen. Government employees become entitle to pension on retirement. There is also no proposal to increase or decrease the age of retirement of Central Government Employees.

(e): The salient features of the pension entitlements of employees retiring from the Central Government are as under:

i. A Government servant retiring in accordance with the rules, after completing a qualifying service of not less than 10 years, is entitled to a pension @ 50% of his last pay or 50% of average emoluments for the last 10 months, whichever is more beneficial to him/her.

ii. After completion of 80 years of age or above, additional pension @ 20% to 100% is payable to the retired Government servant.

iii. A retired/retiring Government servant is entitled to, at his/her option, a lump sum payment, by commutation of a maximum of 40% of his/her pension.

iv. On retirement, a Government employee is entitled to a retirement gratuity based on his/her emoluments and length of qualifying service.

v. On death of a Central Government pensioner, the family is entitled to a family pension the amount of which is 50% of the last pay for a period of seven years, or for a period up to the date on which the retired deceased Government servant would have attained the age of 67 years had he/she survived, whichever is earlier. Thereafter, the amount of family pension is 30% of his last pay. The amount of family pension is also increased by 20% to 100% after the family pensioner attains the age of 80 years and above.

vi. The family of a Government servant, who dies while in service after having rendered not less than seven years’ continuous service, is entitled to a family pension 50% of the last pay for a period of ten years. Thereafter, the amount of family pension is 30% of his/her last pay.

In Lok Sabha today, the Dopt Minister Shri Jitendra Singh said that there is no proposal to reduce the retirement age to 58 years of age or 33 years of service for Central Government employees.

In a written reply for the question regarding the retirement age of Central Government employees in Parliament today, the concerend Minster of State for Personnel Jitendra Singh said that the there is no such proposal to reduce the retirement age with the connection of 33 years of service.

Can the 7th Pay Commission recommend the lowering of retirement age for Central Government employees?

“The unconfirmed information says that the 7th Pay Commission is planning to bring about a dramatic change in the retirement age of Central Government employees.”

Yet another news story about the retirement age of Central Government employees surfaced yesterday. The reputed English news website of India Today featured a special article yesterday about the 7th Central Pay Commission. In the article, the 7th Pay Commission is likely to reduce the retirement age to 55 or on the completion of 33 years, whichever comes first.

This has raised the question in the minds of many if the Pay Commission has the authority to recommend the reducing of retirement age.

The Pay Commission has all the authority to present its explanations and recommendations about changes in the retirement age of Central Government employees. But, the Centre has the discretionary powers to either accept or reject the recommendations. The fifth Pay Commission recommended that the retirement age be increased. Based on the recommendation, the government increased the retirement age from 58 to 60, in May 1998(Click to view the Dopt Order). The Third Pay Commission also recommended the date of retirement of Central Government employees. The commission recommended that the retirement effect from the afternoon of the last day of the month in which the employee concerned attains the age of superannuation instead of the afternoon of the actual date of his superannuation(Click to view the Dopt Order). But, for now, there’s no confirmed news about the recommendation of reduction in retirement age.

Initially it was 60 years of age or 33 years of service, then it changed as 58 or 33 years service and now it becomes as 55/33 years. Though many are ready to even accept the changes in retirement age, what is unpalatable for them is the idea of linking the years of service with their age. If a talented employee joins the Central Government services at a very young age, then he is likely to lose up to seven years of service tenure.

All the government employees, especially those above the age of 40, are vehemently opposing the idea. The questions they are putting forth are –

Recently the news about retirement age is blown out of proportion in Social Media. In Social Media it has been signaled casually that the retirement age will be brought down to 58 years. Initially it was said that 7th pay commission going to recommend the criteria for retirement age as either 33 years of Service or 60 Years of age whichever comes first.

And gradually it is reduced to 58years of age or 33 years of service and finally ends up with 30 years of service or at the age of 55 years.

Does it worth to believe the news circulated in social media about 7th pay commission recommendation and retirement age..? We asked the Federation sources about this and they want to maintain anonymity told that it depends upon the individuals to decide whether it is true or not. We should not blame the media for everything. We should be able to know the difference between the news and rumors.

One of our Sources told that revising the retirement age will not fall under the purview of Pay commission. It should be decided by central government only. No Pay commission has recommended anything about Retirement age so far.
Federation Leaders were asked about this retirement age issue, when it became sensational in Print and e-Media, why don’t they come forward to clear the doubts on this sensational issue?. They told that they didn’t want do give importance to the rumors and hear says.

They said, “We need to clarify the doubts of our cadres across the country whenever it was rumored in social media about their service related sensational issues. But when sensational becomes routine, it’s not our business to respond to such hearsays on daily basis”

“As far as retirement age is concerned we know that 7th pay commission cannot recommend revising the retirement age of central government employees, since it does not fall under the purview of 7th Pay Commission. Even we won’t accept it if the central government tries to reduce the retirement age,” the sources added.

Order for Merger of 50% DA, Retirement age news.

Recently rumour mill went overdrive in social media with the following news that

1. Central Government decided to merge 50% DA with basic pay with effect from 1.1.2015.

2. It went on to say that age of Retirement will be on completion of 33 Years of service or at the age of 58 Years whichever is earlier.

The 7th CPC is expected to submit its report shortly and due to Bihar elections the Central Government cannot take any policy decisions in this regard. Hence it is clarified that none of the above news are correct.
