Recruitment in the Armed Forces is a continuous process. The Government has taken a number of measures to reduce the shortages. These include sustained image projection, participation in career fairs and exhibitions and publicity campaign to create awareness among the youth on the advantages of taking up a challenging and satisfying career.

Further, Government has taken various steps to make jobs in the Armed Forces attractive including improvement in promotion prospects.

This information was given by Raksha Rajya Mantri Shri Shripad Naik in a written reply to Shri A. Vijayakumar in Rajya Sabha today.

Subject: Strengthening of administration – Periodic review of Central Government Employees under Fundamental Rule (FR) 56(j)/(I) and Rule 48 of CCS (Pension) Rules, 1972

The undersigned is directed to refer to this Department’s O.M No.25013/1/2013-EsttA dated 21.3.2014, OM No.25013/1/2013-Estt.A-IV dated 11.9.2015, 11.03.2016 and 10.8.2017 for periodic review of Central Government Employees for strengthening of administration under Fundamental Rule (FR) 560)41) and Rule 48 of CCS(Pension) Rules, 1972.

All Ministries/Departments are requested to undertake the periodic reviews in letter and spirit, including in public sector undertakings (PSUs)/Banks and Autonomous institutions, under their administrative control. Department of Public Enterprises will also compile and countercheck with all concerned Ministries/Departments.

The Ministries/Departments should ensure that the prescribed procedure like forming of opinion to retire a Government employee prematurely in public interest is strictly adhered to, and that the decision is not an arbitrary one, and is not based on collateral grounds as per the order of the Hon’ble Supreme Court in case of U0/ & Col. J.N.Sinha [1571 SCR (1) 791].

All the Ministries/Departments shall furnish a report to DoP&T in the format given below by 15th day of each month starting from 15th July, 2019. Department of Public Enterprises are requested to also compile and counter check the data with all concerned administrative Ministries/Departments in respect of PSUs before furnishing the report to DoP&T.

State Bank of India (SBI) has informed that there is no plan to launch Voluntary Retirement Scheme (VRS) in their bank at present.

SBI has informed that VRS was offered by the erstwhile Associate Banks of SBI to their employees and officers before merger and three thousand five hundred sixty nine (3569) employees/officers of erstwhile Associate Banks had opted for the same.

The abvoe information given by the Minister of State in the Ministry of Finance Shri Santosh Kumar Gangwar in a written reply to a question in Rajya Sabha on 25.07.2017.

Department of Public Enterprises (DPE), Ministry of Heavy Industries & Public Enterprise has recently issued guidelines to expedite the process for closure of CPSEs so that all administrative Ministries would follow uniform procedure for closure of the CPSEs. Earlier, DPE had issued guidelines for “streamlining the mechanism for revival and restructuring of sick/ incipient sick and weak Central Public Sector Enterprises: General principles and mechanism of restricting”. As per these guidelines, the CPSEs were to be categorized into strategic and non-strategic and revival/restructuring strategy was prescribed. However, there are certain CPSEs in non-strategic sector which have no scope for revival and are to be closed in a time bound manner. Since there are employees working in these CPSEs, Government decided that closure should not cause hardship to them and has now laid down a uniform policy to give workers VRS at 2007 notional pay scale irrespective of the pay scale in which they are working.

The guidelines also prescribe the modalities for disposal of movable assets and immovable assets. The guidelines prescribe that leasehold land would be dealt as per the terms of the lease and freehold land would be offered in following order of priority:-

(i) Central Government Departments.

(ii) Central Government bodies/CPSEs.

(iii) State Government Departments.

(iv) State Government bodies/State PSEs/State authorities.

In case the above categories are not interested in taking the land for six months, then the land would be auctioned through MSTC to any entity so that it can be put to productive use.

“Compulsory Retirement under CCS Rules – Following are the consequences of a law imposed by DoPT.”

The Armed Forces, Railways, Defence, and Deaprtment of Post are among the largest employers under the control of the Central Government. The largest among them, the Railways, employs more than 13 lakh employees. In all, the Central Government employees more than 34 lakh, and has more than 38 lakh pensioners on its list.

The Centre has now ordered the implementation of an old and forgotten law. According to Section 56 (J) and 56 (I) or Rule 48(1) (b) of CCS (Pension) Rules 1972, the performances of those between the ages of 50 and 55, and those who have completed 30 years of service must be reviewed by senior officers once every three months, vis. Jan to Mar, Apr to Jun, Jul to Sep and Oct to Dec. All the departments have been ordered to review the performances and implement this rule immediately. And also advised to constitute a Review Committee consisting of two Members at appropriate level.

Relevant orders to this effect were issued on September 11. Senior officials and employees of various departments are confused and terrified following the orders.

Some claim that the government has taken this step to stifle the indefinite strike to be held in November. The Central Government employees union and the railway employees’ union claim that, armed with this rule, the government can send home workers under the compulsory retirement scheme.

The order quoted, “If conduct of a government employee becomes unbecoming to the public interest or obstructs the efficiency in public services, the government has an absolute justify to compulsorily retire such an employee in public interest.”
